State of play, main conclusions, outlook

Regulation (EU) No 660/2014 amending the Waste Shipments Regulation (WSR) aimed at a reduction in administrative costs by companies and public administrations in the management of waste shipments and at the same time allowing for increased repatriation of illegal waste shipments. Savings linked to the Regulation (EU) No 660/2014 were estimated in 2010 at € 44 million corresponding to 50% of the administrative baseline burden. These savings were confirmed in legislative procedure. Member States feedback on implementation in spring 2015 showed cost reductions beyond those initially estimated by the Commission totalling up to 70% of the administrative baseline burden for 5 Member States.

Article 60 of the Regulation provides that the Commission should carry out a review of the Regulation and submit a report to the European Parliament and to the Council, accompanied, if appropriate, by a legislative proposal. As a first step the Commission carried out an evaluation of the Waste Shipments Regulation, which was finalised in January 2020.

The evaluation of the Waste Shipments Regulation assessed unnecessary administrative or technical barriers in this Regulation due to delays in handling of procedures between the involved competent authorities and during transport. These burdens take the format of personnel deployed by companies involved in waste shipment and were considered medium to high by competent authorities and enforcement agencies.

Building on the findings of the evaluation, the Commission adopted in 2021 a proposal for the revision of the Regulation.

REFIT Platform

In 2018 the REFIT Platform adopted an opinion on the shipments of waste (Ref. IX.3.a-c) in which it recommended the Commission to use the review of the Regulation to get clarity on the unclear definition of waste and status of certain waste and the potential consequences to enhance waste recycling in the EU, and ensure that definitions and interpretations are harmonised across the Member States.

It further recommended to consider more types of waste to be added to the so-called "green list" (after thoroughly analysing the properties of the types of waste and their potential impact on the environment) and to strengthen the monitoring and the control of waste streams as well as the mutual recognition of national registries of waste carriers. It was also suggested to investigate how to establish a registry of certified recycling facilities and how to reduce licensing duties in EU if waste is shipped to any of these certified facilities.

These elements were considered by the Commission in its preparatory work for the proposal for the revision of the Waste Shipments Regulation, together with a variety of other measures, such as a shift from a paper-based procedural system to the electronic interchange of data, streamlining existing procedures, favouring shipments to reuse and recycling and restricting the export outside the Union. Measures to enhance and strengthen enforcement were also considered.
