Commission proposal: on-going, planned for adoption Q1 2023
The recent Chemicals Strategy for Sustainability commits to strengthen the Toy Safety Directive (and other sectorial legislation) regarding the protection of children from other most hazardous chemicals and with regard to possible combination effects of chemicals. The Commission’s evaluation of the Toy Safety Directive identified several shortcomings that could compromise the health and safety of children, in particular on chemicals. Also, there are still too many unsafe products on the Union market. The Commission has initiated the process for the revision of the Directive to protect children better against risks in toys, particularly from chemicals. It builds on work such as the chemicals strategy for sustainability, and the results of the evaluation of the current toy safety rules completed in 2020. At the same time, it aims to strengthen the Single Market for toys.
The Commission is currently working on an impact assessment to look into possible options for the revision of the directive, in view of strengthen the protection of children and the single market for toys.
An inception impact assessment was published on 5 October 2021, with feedback on it being possible until 2 November 2021. A public consultation was launched on Have your say portal on 2 March 2022 until 25 May 2022. The Commission aims at presenting a legislative proposal for the revision of the directive in the first quarter of 2023.
