Recommendation concerning the definition of micro, small and medium-sized enterprises (2003/361/EC) – the SME Definition

State of play, main conclusions, outlook

Small and medium-sized enterprises (SMEs) represent 99% of all businesses in the EU. The definition of an SME is important for access to finance and EU support programmes targeted specifically at these enterprises. The definition’s structure and scope have been assessed at several instances. After its entry into force on 1 January 2005, implementation reports were prepared in 2006 and 2009 and an evaluation was made in 2012. In 2018, the Commission decided to re-assess to what extent the definition remains fit for its purpose. A Staff Working Document was published in 2021.

In particular, the assessment focused on 3 main areas: whether the definition is still relevant under the current economic situation; whether the definition is clear enough to be interpreted in a uniform manner and provide legal certainty so that only ‘genuine’ SME benefit from the status; whether the definition is coherent with recent Commission policy initiatives focusing on the growth of SMEs (i.e. start-ups and scale-ups).
