State of play, main conclusions, outlook

In its efforts to improve road safety, the European Union considered new measures and activities, as well as reviewing existing legislation. In this context, the Commission assessed two pieces of legislation dealing with road infrastructure and tunnel safety issues: Directive 2008/96/EC and Directive 2004/54/EC, with a view to analysing whether they are still fit for current realities and needs. In line with Directive 2008/96/EC, Member States have to put in place and implement 'procedures relating to road safety impact assessments, road safety audits, the network-wide road safety assessment and safety inspections (periodic and targeted)', while Directive 2004/54/EC aims at ensuring 'a minimum level of safety for road users in tunnels in the trans-European road network'.

In 2015, two external studies assessed the implementation of Directive 2004/54/EC (Tunnel Directive) and of Directive 2008/96/EC (Road Infrastructure Safety Management (RISM) Directive) by the Member States.

Building on those results, the Commission adopted in 2018 a proposal for the revision of the Road Infrastructure Safety Management Directive. The general objective of the proposed initiative was to reduce road fatalities and serious injuries on EU road networks by improving the safety performance of road infrastructure. The specific objectives included: improving the follow-up on the findings of road infrastructure safety management procedures; fostering harmonisation and knowledge sharing between Member States on these procedures and requirements; protecting vulnerable road users; improving the deployment of new technologies; and working towards a consistently high level of road safety across Member States, using the limited financial resources efficiently.

Following adoption by the European Parliament and Council, the amending Directive (EU) 2019/1936 applies since 16 December 2019.
