The evaluation found that the applicable legislation on market access rules in road freight transport was only partly effective in achieving their original objective of creating suitable competitive conditions in the market due to difficulties encountered in the practical application and enforcement.
On this basis, on 31 May 2017, the Commission adopted a proposal aiming at clarifying and simplifying certain provisions of Regulations (EC) No 1071/2009 and 1072/2009. The proposal also aimed to strengthen enforcement requirements for Member States. The proposed amendments would facilitate the implementation of the Regulations by Member States, decrease administrative burden for hauliers and bring a more uniform application across the EU.
The legal act was adopted in 2020 (Regulation 2020/1055 on the access to the road transport market) and it retains the simplification aspects from the Commission proposal.
The estimated savings for businesses from the revised Regulations are between 5.2 and 6.9 billion euros for the EU-28 in 2020-2035.
The proposal was also meant to lead to more effective monitoring and enforcement of the rules and fewer infringements. The expected reduction of infringements of cabotage rules is up to 62 % and the reduction of the risk of letterbox companies is about 10 %.
