Greening / Ecological Focus Areas

State of play, main conclusions, outlook

The initiatives in this area should provide a full overview on how this new policy instrument is performing, identify main obstacles to its implementation and come forward with concrete suggestions for simplification leading to reduced administrative costs.

The first step was a review carried out in the first half of 2016 assessing how the greening system was applied in its first year (SWD(2016)218). The results of this review fed the process of adjusting the underlying secondary legislation (Delegated Regulation (EU) 2017/1155). A Commission report on implementation of Ecological Focus Area was adopted in 2017 (COM(2017)152). In 2017 several changes were made to some greening parts of the underlying basic legislation (Regulation (EU) 2017/2393, the so-called 'Omnibus' Regulation), followed by adjustments to the secondary legislation (Regulation 2018/1784). In November 2018, the Commission finalised an evaluation of the performance of the full set of greening provisions (SWD(2018)478). The results of this evaluation have informed the discussion on the post-2020 CAP. In 2018, a study analysing administrative burden arising from the CAP was finalised.

REFIT Platform

The REFIT Platform adopted two opinions on the subject suggesting notably to evaluate (cost-benefit, effectiveness) and review the “greening” scheme. Specific suggestions were made on adjusting thresholds from which the greening requirements apply, changing weighting factors applicable to some ecological focus areas (EFA) types, changing the system of protection/maintenance of the share of permanent grassland (ratio) and modifying the rules distinguishing permanent grassland and arable land (as regards land lying fallow). The opinions also called for more proportionate and transparent calculation and reduction of greening payments (in case of non-compliance).

Estimated savings and benefits

The efficiency of the greening measures was also examined as part of the evaluation on greening of 2018. The results of dedicated studies on the administrative burden and the costs of managing the Common Agricultural Policy were published in 20191.
