Regulation (EC) No. 1206/2001 has created a uniform European system of judicial cooperation for the purposes of taking cross-border evidence in civil and commercial matters. The Regulation establishes simple and rapid mechanisms of cooperation between the courts of the different Member States for the purpose of taking evidence. It represents a significant progress compared to the cooperation mechanisms contained in the Hague convention, which was replaced by the Regulation.
The Regulation has undergone detailed assessments over the past years in studies and discussions in the European Judicial Network in Civil and Commercial matters.
From these assessments, it was concluded that, notwithstanding its overall success, the Regulation needs to be modernised in order to promote the use of new technologies (electronic means of communication, videoconferencing) and to eliminate possible uncertainties concerning the application of the Regulation.
In order to address these challenges, the Commission has proposed a legislative act on the modernisation of the instrument. To be able to provide pertinent and up-to date data the initiative was accompanied by an impact assessment accompanied by an evaluation.
The , Regulation (EU) 2020/1783 of the European Parliament and of the Council of 25 November 2020 on cooperation between the courts of the Member States in the taking of evidence in civil or commercial matters (taking of evidence) (recast) became applicable partially 01.07.2022 and the part related to the decentralised IT-system will become applicable from 01.05.2025.
