State of play, main conclusions, outlook

The codification of Regulation (EC) No 562/2006 establishing a Community Code on the rules governing the movement of persons across borders compiles several amendments to the Schengen Borders Code, such as the use of the Visa Information System (Regulation (EC) No 81/2009) and the amendments of 2013, into one legal text.

This codification ensured that provisions were clearer and readily understandable and offered better certainty as to the law applicable. Codifying various legal acts into one instrument, without substantive changes, increases the transparency and readability of legislation, leading to simplification.

A new proposal of an amendment of Regulation 2016/399 concerns the following issues:

- Measures available at the external borders in the situation of instrumentalisation of irregular migrants;

- Lessons learnt from COVID-19 as regards measures applicable at the external and internal borders;

- Rules applicable to temporary reintroduction of internal border controls and to alternative measures within the territory.
