Commission proposal: on-going, envisaged adoption in 2023
In February 2020, the European Commission published an evaluation of the functioning of Directive 2011/64/EU. The evaluation examined if the excise duty rates applied to manufactured tobacco have protected public health and ensured a proper functioning of the internal market. The evaluation showed that regarding burden and simplification potential, regulatory burden is not an issue for Member States authorities nor for operators. Compliance costs are actually mainly related to the Horizontal Directive that oversees all arrangements concerning excise systems and the movement of excise goods overall (Council Directive 2008/118/EC). There remain however legal uncertainties that would need to be addressed.
On 2 June 2020, the Council adopted a set of conclusions on the review of the Directive, based on the findings from the evaluation. The Council invited the Commission to undertake the necessary studies to submit a legislative proposal for revision of Directive 2011/64/EU. The revision of the Directive is listed in the annex of the Commission Work Programme 2021 (COM(2020) 690). The Commission is preparing an impact assessment following extensive public and stakeholders consultation, and supported by an external study.
