DG CONNECT commissioned a team, led by ICF, to conduct a study to further inform policy-making in the field of online intermediary liability and combating illegal content online. The purpose of the study was to: - Provide a comprehensive and up-to-date view of the implementation of Article 14 and, insofar as hosting service providers are concerned, Article 15 of the E-Commerce Directive (ECD)1 in European Union (EU) Member States, and describe the relevant national frameworks, such as self- or co-regulatory arrangements. - Obtain evidence of the volume of content currently reported to hosting service providers and the proportion of various types of illegal content reported; understand the processes put in place by hosting service providers by which users and authorities can report illegal content, document the voluntary measures taken by hosting service providers to tackle illegal content and their effectiveness, and understand the cost implications of those procedures for both hosting service providers and notifiers.
