Directive 2002/96/EC on waste electrical and electronic equipment (WEEE) introduced minimum requirements for the collection and treatment of WEEE. In order to assist operators in meeting these requirements, the Commission under the recast Directive 2012/19/EU, Article 8(5), requested the development of European standards for the treatment of WEEE, which were subsequently developed and published by CENELEC. Article 8(5) also provides the option for the Commission to adopt Implementing Acts laying down minimum quality standards for WEEE treatment based in particular on the European standards. Furthermore, Article 10(3) requires the Commission to adopt a Delegated Act, laying down criteria for the assessment of equivalent conditions for the treatment of WEEE outside the EU, as required by Article 10(2). This study supports the Commission in view of possible action to follow-up on the requirements of Articles 8(5) and 10(2) by providing related recommendations. Based on an analysis of the environmental, economic, health and social impacts of setting additional treatment requirements under EU WEEE legislation and the analysis of the situation in the Member States, a proposal with key elements of additional minimum treatment requirements for WEEE was elaborated. For assessing equivalent conditions of WEEE treatment outside the EU, either a proof of compliance with specific international standards for WEEE treatment or a declaration of conformity with the treatment requirements under Directive 2012/19/EU issued by a third party verifier are proposed.
