This evaluation of Regulation (EC) No 1924/2006 on nutrition and health claims made on foods (the ‘NHCR’), with regard to harmonised nutrient criteria governing their use (Article 4.1) and health claims made on plants and their preparations (Article 13), assessed the impacts of the current situation (non-implementation). In addition, the study covered: the extent to which existing voluntary schemes/initiatives pursuing nutritional objectives, as well as the mandatory nutrition declaration, contribute to the objectives of Article 4.1; and, the adequacy of the general regulatory framework for the use of plants and their preparations in foods. The evidence base comprised: literature review; online surveys of the EU-28 Member State Competent Authorities and of organisations representing the food supply chain, NGOs and consumers; an SME Panel addressed to SMEs active in the food supply chain; interviews (EU; MS; selected third country authorities); thematic case studies; and, an open public consultation of EU-28 citizens. The analysis focused on establishing whether systematic problems/shortcomings could be identified as a result of the current situation. Five key criteria were analysed: relevance; effectiveness; efficiency; coherence with wider EU policy priorities; and, EU added value. Gaps/shortcomings were found to arise from the non-implementation of the above provisions of the NHCR, as well as from the non-harmonised nature of the current general regulatory framework applicable to plants and their preparations used in foods. Thus, the study identified the need to proceed with the implementation of harmonised, targeted action in these areas.
