Report on the EU guidelines on promoting compliance with international humanitarian law January 2023 - December 2023

International humanitarian law (IHL) sets out rules limiting and mitigating the impact of armed conflict. Establishing a careful balance between humanitarian considerations and military requirements, IHL constitutes a set of fundamental safeguarding rules under international law. The scope of IHL protection not only encompasses combatants who take an active or direct part in hostilities, but also aims to cover the most vulnerable persons affected by a conflict who are not, or who are no longer, taking part in hostilities, such as civilians, the wounded and the sick, and persons deprived of their liberty. It also restricts the means and methods of warfare used by the parties involved. IHL defines the obligations of all parties involved in an armed conflict and introduces a system of responsibilities for those who breach theirs. All states have to respect and ensure respect for the universally accepted rules and principles of IHL in all circumstances. With the adoption in 2005 of the European Union Guidelines on promoting compliance with international humanitarian law (‘the Guidelines’), the EU has sent a clear signal that compliance with the IHL framework constitutes one of its priorities. The Guidelines aim to provide an overview of the range of operational tools available to the EU in promoting compliance in its relations with third states and international actors, as well as guidance for understanding IHL rules and principles. Since 2018, the Working Party on Public International Law (COJUR) has published an annual voluntary report on the implementation of the Guidelines. The purpose of that report is to monitor the means of action, to increase the visibility of the wide range of measures undertaken in support of IHL and to facilitate the Council’s assessment of the EU’s work in that field. This seventh report covers the period from 1 January 2023 to 31 December 2023.
