The study provides technical assistance to the European Commission to specify and operationalise the derogations for the prohibition on the destruction of unsold apparel and footwear. Article 25(5) of the ESPR outlines potential reasons for these derogations, for the consumer products listed in Annex VII. The study evaluates the applicability of each potential derogation and developed questions for an online stakeholder consultation. Feedback from this consultation, along with a literature review, was crucial in specifying the cases for each derogation as narrowly as possible. The operationalisation of the derogations details the documentation that economic operators must maintain to prove the applicability of each derogation. An initial draft of the specifications and operationalisations for each derogation was presented in an online stakeholder workshop. Subsequent in-depth interviews provided further specific information from the apparel and footwear sector. The specifications and operationalisations were then finalized, and an indicative overview of the impacts was summarized.
