Virtual assets (VAs) and their legal status have been under regulatory scrutiny in recent years. The international standard setting body in the area of anti-money laundering and combatting the financing of terrorism (AML/CFT) – the Financial Action Task Force (FATF), recommended the introduction of harmonised processes for sharing of information on VA transfers between virtual asset service providers (VASPs) and keeping this information available for competent authorities. In 2020, the European Commission adopted its digital finance strategy and two legislative proposals: (i) on virtual assets and (ii) on digital resilience. The draft Regulation on markets in crypto-assets (MiCA)1 aims to provide a legal framework and definition for virtual assets and virtual asset services providers. In July 2021, the Commission presented a new AML/CFT legislative package with a more harmonised set of rules to be applied across the European Union, including provisions to implement the latest recommendations of the FATF on the sharing of VA transfer users. Under the Fifth Anti-Money Laundering Directive, the Commission must draw up a report on the implementation of the Directive including a report “with respect to virtual currencies, empowerments to set-up and maintain a central database registering users’ identities and wallet addresses accessible to financial intelligence units, as well as self-declaration forms for the use of virtual currency users”. The presented study assesses the possible means to identify virtual assets users and the possibility for the European Commission to set-up and maintain a central database registering users’ identities and wallet addresses accessible to financial intelligence units (FIUs).
