The Contractor/Supervisor shall ensure that the Technical Project is drawn up in accordance with the legal regulations in force, in compliance with all the stages of Government Decision No 907/2016 on the stages of preparation and the framework content of the technical and economic documentation relating to the objectives/projects of investment financed by public funds, as amended. SUSPENSIONAL CLAUSIS: The award procedure shall be governed by these suspensive clauses. The conclusion of the sectoral procurement contract is conditional on obtaining / approving the financing of the works from funds from the state budget and / or non-reimbursable European funds, the signing of the contract being possible only if the provisions regarding the commitment of expenditure from budgets falling under the legislation on public finances are complied with. If, for any reason, obtaining/approving the financing of the works from funds from the State budget and/or non-reimbursable European funds is not carried out, the Contracting Entity shall apply the second sentence of Article 225(1)(c) of Law No 99/2016, as subsequently amended and supplemented, making it impossible to conclude the sectoral procurement contract. The Contracting Entity expects to obtain the necessary financing for the signature of the contract within 12 months of the approval of the report of the procedure. - The conclusion of the sectoral consultancy and supervision procurement contract is subject to the conclusion of the contract for the design and execution of works relating to the investment objective for ‘Rehabilitation of the railway line Dărmănești – Vicșani – Frontier’ – Stage 1 – Lot 2 – Rehabilitation works Pod km 0+522 subject to consultancy and supervision services. The transmission of the Order for the start of the Contract is conditioned by the existence of the design and execution contract that will be the subject of the present consultancy and supervision services or under the condition of the existence of the premises for the actual start of the design and execution contract.
