This report concerns a “study supporting the fitness check on the most relevant chemicals legislation”. The use of chemical substances within Europe forms a core part of the everyday lives of EU citizens, covering the diverse set of goods manufactured and used across Europe. The European Chemicals Agency’s classification and labelling (C&L) inventory has reported notifications covering some 130,000 unique substances, highlighting the sheer diversity of substances in use. EU regulation is needed to manage the safe manufacture and use of chemicals to ensure a high level of protection for human health and the environment, whilst also maintaining the functioning of the internal market and promotion of competitiveness and innovation. The EU’s chemicals acquis, covering a legislative framework for chemicals, began in 1967 with the Dangerous Substances Directive, and has since grown into a body of interconnected legislation covering the wide range of applications for the manufacture and use of chemicals in the EU. Chemicals and chemicalsrelated legislation spans more than 100 directives and regulations. As part of the fitness check roadmap the European Commission has targeted a review of the risk assessment procedures used within the most relevant chemicals legislation. This is intended to look at the functioning of risk assessment procedures for their effectiveness, efficiency, coherence, relevance and EU added value. In 2015 a “First Study” commenced to examine “the regulatory fitness of the legislative framework governing the risk management of chemicals (excluding REACH), in particular the legislation covered by, and linked to, the CLP (Classification, Labelling and Packaging) regulation”. The objective of the First Study was therefore to evaluate the CLP Regulation and the interface with other related chemicals legislation, including other legislation governing hazard identification and communication and legislation establishing risk management measures linked to CLP. It thereby covered a substantial part of the scope identified within the fitness check roadmap, but not all aspects. Specific risk assessment procedures were not investigated in detail, particularly those that are not linked to CLP.
