As highlighted in the frame of past evaluations and stakeholders' feedback, the European legislation on Passenger Ship Safety (PSS) is fragmented and not always consistent. The Commission has therefore initiated a more systematic fitness check (FC) of the overall legislation in place. The EC wants to ensure a uniform high safety level for all passenger ship types, eliminate barriers in the Internal Market (IM) and simplify and streamline the regulatory framework. This support study provides specific input to the Commission to feed into the FC. The study consisted of several tasks. National data on fleets, accidents, certifications, safety standards, IM transactions... was analysed. The European PSS Market was characterised and analysed, and a Cost Benefit Assessment was performed. The outcome of the study was that the objectives of the European legislation correspond with the general safety challenges of competitive and sustainable passenger ship operation. Although prima facie the IM might come under some pressure with respect to ships not covered by the European directives, since national standards in this respect may differ from each other, only regarding small ships (<24m) built in other materials than steel possible distortions might arise as a consequence of a lack of common EU standards, although the exercise has demonstrated that there is practical no transfer of ships (<24m) currently under the directive.
