This report presents the findings of the “Fitness Check – Support study on the access to and the functioning of the inland waterway transport market”. This study was carried out on behalf of the Directorate-General for Mobility and Transport of the European Commission, and it generates evaluation findings for any potential future revision of the legislation in scope of the Fitness Check. The scope of this study encompasses seven legal acts adopted between 1960 and 1999: the prohibition of price discrimination was the first legislation introduced (1960), followed by the legislation focusing on the opening of the market (opening of the waterways and the occupation - between 1985 and 1996). The last elements added to the framework were the prohibition of fixed prices (1996) and reduction of structural overcapacity (1999). Based on their objectives, the seven legal acts were allocated to four thematic groups and two pillars. This evaluation study responds to 37 evaluation questions, clustered by the evaluation criteria of relevance, effectiveness, efficiency, coherence and EU added value; some defined at the above-mentioned group level, some at horizontal level and some at the overall legislative framework level. The report presents a synthesis of findings by group of acts and by pillars; the findings at group and pillar level constitute a bridge towards evaluation the Internal Market Legislative Framework for inland waterway transport, providing an opportunity to identify overlaps and gaps as input for the fit-for-purpose assessment. Conclusions of the Fitness Check are presented at two levels, i.e., at the level of the five evaluation criteria and at the level of the four thematic groups.
