1.   Resumption of the session

The sitting opened at 18.05.

2.   Statements by the President

The President made the following statements.

He spoke of the death of the French journalist Gilles Jacquier, who had been killed in shelling at Homs (Syria) on 11 January, and said that over one hundred journalists had been killed in 2011 while doing their job.

He spoke of the shipwreck of the cruise liner Costa Concordia off the Italian coast on 13 January, which had claimed at least six victims, and offered his condolences to the victims' families.

He paid homage to the former MEP Manuel Fraga Iribarne, who had died on 15 January, and offered his condolences to his family.

Lastly, he paid homage to the memory of Václav Havel, who had died on 18 December 2011.

Parliament observed a minute's silence.

3.   Composition of Parliament

The Spanish authorities had given notice that José Manuel García-Margallo y Marfil had been appointed a member of the Spanish Government with effect from 21 December 2011.

As this office was incompatible with that of a Member of the European Parliament under Article 7(1) of the Act concerning the election of the members of the European Parliament by direct universal suffrage, Parliament had established the vacancy of his seat, under Rule 4(1) and (4), with effect from 21 December 2011, and had informed the Member State concerned.

The competent Spanish authorities had given notice that Íñigo Méndez de Vigo had been appointed a member of the Spanish Parliament with effect from 23 December 2011.

As this office was incompatible with that of a Member of the European Parliament under Article 7(1) of the Act concerning the election of the members of the European Parliament by direct universal suffrage, Parliament had established the vacancy of his seat, under Rule 4(1) and (4), with effect from 23 December 2011, and had informed the Member State concerned.

The Spanish authorities had given notice of the election of Maria Auxiliadora Correa Zamora to replace José Manuel García-Margallo y Marfil as Member of Parliament with effect from 13 January 2012.

The Spanish authorities had given notice of the election of Juan Naranjo Escobar to replace Íñigo Méndez de Vigo as Member of Parliament with effect from 13 January 2012.

Under Rule 3(2), until such time as their credentials had been verified or a ruling had been given on any dispute, and provided that they had previously made a written declaration stating that they did not hold any office incompatible with that of Member of the European Parliament, Maria Auxiliadora Correa Zamora and Juan Naranjo Escobar would take their seats in Parliament and on its bodies and would enjoy all the rights attaching thereto.

Ilda Figueiredo had given notice in writing of her resignation as a Member of Parliament, with effect from 18 January 2012.

Michail Tremopoulos had given notice in writing of his resignation as a Member of Parliament, with effect from 2 February 2012.

Elizabeth Lynne had given notice in writing of her resignation as a Member of Parliament, with effect from 4 February 2012.

Under Rule 4(1), Parliament had established the vacancy of their seats as from those dates, and had informed the Member States concerned.

Following the entry into force of the Protocol amending Protocol 36 on transitional provisions concerning the composition of the European Parliament until the end of the 2009-2014 parliamentary term, the Netherlands authorities had appointed Daniël van der Stoep to fill the additional seat allocated to the Netherlands with effect from 15 December 2011.

The Spanish authorities had given notice of the election of Ana Miranda to replace Oriol Junqueras Vies as Member of Parliament with effect from 1 January 2012.

The French authorities had given notice of the election of Younous Omarjee to replace Elie Hoarau as Member of Parliament with effect from 4 January 2012.

Under Rule 3(2), until such time as their credentials had been verified or a ruling had been given on any dispute, and provided that they had previously made a written declaration stating that they did not hold any office incompatible with that of Member of the European Parliament, Daniël van der Stoep, Ana Miranda and Younous Omarjee would take their seats in Parliament and on its bodies and would enjoy all the rights attaching thereto.
