Description

1. The subject of the contract is the performance of a service consisting in organizing and conducting three Camps for a total of 200 Participants as part of the project: ‘Regional programme for equalising educational opportunities for pupils of Pomeranian schools’, where:1)The contracting authority divided the contract into lots. The contract was divided into 3 (three) lots: •Part 1: Camp with interdisciplinary workshops for 80 participants – two camps (40 participants in each camp), •Part 2: Thematic camp – Digital technologies in learning and play for 80 participants – two stays (40 participants per stay), •Part 3: Thematic camp – Maritime and nautical education for 40 participants – one tour. 2) The Contractor may submit an offer for any/next part(s) of the order. 2.The description of the subject of the contract (including the description of the part of the contract) is set out in Annex 1 to the SWZ and in the model contract, which is Annex 2 to the SWZ. The law applicable to this contract (including the contract concluded as a result of this procedure and the assessment of the legal effects of all documents in this contract) is Polish law, taking into account European Union law. 4.In all the provisions of the SWZ and its annexes, in which the Contracting Authority refers to standards, approvals, technical specifications or reference systems or indicates trademarks, parameters or sources of origin (names of manufacturers or devices), in accordance with Art. 5 and Article 101 para. 4 of the Public Procurement Act, the Contracting Authority allows equivalent solutions. 5.If the description of the subject of the contract gives the names of materials, products of specific manufacturers, it should be treated only as a statement of the desired standard and quality. In all such situations, the Contractor may offer equivalent materials, products with at least the same technical and quality characteristics. Equivalence of the product is understood as offering a product whose technical parameters of the materials used, performance, durability and quality are not inferior to the quality of the materials, products described in the SWZ. 6.The Contractor who refers to equivalent solutions is obliged to demonstrate that the solution offered by him meets the requirements specified by the Ordering Party. In this case, the Contractor shall attach to the tender a list of equivalent solutions together with its description or standards. 7.The Ordering Party does not reserve the obligation to personally perform key parts of the contract by the Contractor. The Contractor may entrust the performance of part of the contract to a Subcontractor. 8.Subcontracting: 1) The contractor may entrust the performance of part of the contract to a subcontractor (subcontractors). 2) In connection with the performance of the contract, the Ordering Party does not reserve the obligation to personally perform the key tasks of the contract. 3) The Contracting Authority requires that in the case of entrustment of part of the contract to subcontractors, the contractor shall indicate in the tender the parts of the contract which it intends to entrust to subcontractors and indicate (if already known) the names of these subcontractors. 4) Entrusting part of the contract to subcontractors does not release the contractor from liability for proper performance of the contract. 9.The Contracting Authority does not reserve the possibility of applying for a contract only by the Contractors referred to in Article 94 of the Public Procurement Act. 10.Due to the nature of the contract, the Contracting Authority does not require the Contractor or Subcontractor to employ, on the basis of an employment relationship, persons performing activities during the performance of the contract referred to in Article 95 of the Public Procurement Act. 11.The Contracting Authority does not provide for an obligation for the Contractor to carry out an on-site inspection and check by the Contractor the documents necessary to perform the order available on-site at the Contracting Authority. 12.The Contracting Authority does not allow the possibility of submitting a variant offer referred to in Article 92 of the Public Procurement Act, i.e. an offer providing for a different method of performance of the contract than specified in this SWZ. 13.The Contracting Authority does not provide for the conclusion of a framework agreement and the establishment of a dynamic purchasing system and does not provide for the selection of the most advantageous tender using an electronic auction. 14.The Contracting Authority does not provide for the award of contracts on the basis of Art. 1 point 7 of the Public Procurement Act. 15.The Contracting Authority does not allow submitting an offer in the form of electronic catalogues or attaching electronic catalogues to the offer, in the situation specified in Article 93 of the Public Procurement Act. 16.The Ordering Party does not provide for settlement in foreign currencies. Settlement of the order is carried out in PLN. 17.The Ordering Party does not provide for reimbursement of costs of participation in the procedure. 18.The Ordering Party does not provide for the granting of advances for the performance of the contract. 19.The Ordering Party requires that the Contractor performing the subject of the contract be entered in the Central Register of Tourism Organizers and Entrepreneurs Facilitating the Purchase of Related Tourism Services and thus meet the requirements of the Act of 24 November 2017 on package travel and related tourist services (Journal of Laws of 2023, item. 2211 as amended). Pursuant to Article 359 of the Public Procurement Law, when awarding contracts for social services, the provisions of the Act applicable to classical contracts with a value equal to or exceeding the EU thresholds shall apply - if the value of the contract expressed in PLN is equal to or exceeds the equivalent of EUR 750 000, with the possibility of excluding the application of selected provisions of the Public Procurement Law referred to in Article 360 of that Act. The contracting authority in accordance with Art. 1 of the Public Procurement Act informs that in the first place it will examine and evaluate the tenders, and then it will qualify the Contractor whose tender has been awarded the highest score in terms of the lack of grounds for exclusion and fulfilment of the conditions for participation in the procedure. The Contracting Authority shall not require the Contractor to submit the means of proof in question.
