Description

The subject of the acquisition is the continuation of unfinished structural design in Hyvinkää Arena. The contract of the structural designer acquired by the client as a public procurement will be terminated in the middle of the assignment. The client could not have known in advance that the structural designer would not be able to perform the task in accordance with the contract. The project is at a very critical stage in terms of schedule and it is not possible to interrupt the planning and already started production for the duration of the new tendering procedure without significant direct and indirect additional costs and without significant delay in the project. Direct procurement is based on Section 40 of the Procurement Act in the circumstances referred to in paragraph 2(4): ‘The contracting entity may opt for direct award if: (4) the award of the contract is strictly necessary and the time-limits laid down cannot be complied with because of extreme urgency caused by unforeseeable circumstances beyond the control of the contracting entity;’;
