The Techniker Krankenkasse aims to conclude discount agreements under § 130a(8) SGB V on the active ingredient insulin glargine (extraction 100 U/ml) with all appropriate pharmaceutical companies.
The contract is concluded as part of the Open House Biologics procedure of the Technicians’ Health Insurance Fund:
Individual negotiations on the content of the contract are not conducted, uniform conditions apply. The Techniker Krankenkasse does not guarantee exclusivity to individual contractors.
The rebate agreements also ensure the regulatory capacity of insulin glargine (exchange of 100 U/ml) to treat type 2 diabetes mellitus in accordance with the provisions of the decision of the Joint Federal Committee of 18 March 2010.
The maximum duration of the contract will be 24 months starting on 01/09/2015. The contract shall end no later than 31/08/2017, irrespective of the date of conclusion of the contract. Accession to this open-house biologic procedure is possible at any time within the duration of the contract. A contract is concluded with all pharmaceutical companies who fulfil the requirements of Annex 3 to the contract (self-declaration of authorisation and company) and who confirm this by their signature. The non-exclusive discount agreements concluded in the open-house biologic procedure of TK are in principle intended to bridge the period between the expiry of the patent of active ingredients, combinations of active ingredients or pharmaceutical forms and the entry into force of exclusive discount agreements under Paragraph 130a(8) of the SGBV. TK reserves the right, during the contract period, to replace the non-exclusive open-house biologic rebates with exclusive discount contracts concluded in the context of a call for tenders falling within the scope of antitrust procurement law. On the entry into force of the exclusive discount agreements, TK will terminate the open-house biologic rebate contracts in accordance with the relevant statutory and contractual provisions. In the light of TK’s experience, exclusive discount contracts will normally enter into force from 8 to 10 months after the publication of the relevant tender notice in the Supplement to the Official Journal of the European Union. Future contractors are invited to consult regularly the Supplement to the Official Journal of the European Union regarding these tender notices.
This notice does not concern the award of a public contract within the meaning of the Public Procurement Coordination Directive (2004/18/EC) or the antitrust rules. This notice shall be published in the Supplement to the Official Journal of the European Union in order to provide the widest possible information to interested pharmaceutical business operators. The term ‘open procedure’ used in the context of this notice (point IV.1.1)) is due to the requirements of the notice form. This, as well as the use of the TED medium, is not subject to rules of public procurement law, the validity of which is not mandatory by law or procurement regulations.
