Description

The subject-matter of the contract is a 24-hour medical service for persons detained by the Mazowieckie Garrison Police.
1. The subject of the contract must be performed in accordance with the provisions laid down in the Regulation of the Minister for the Interior of 13 September 2012 on medical examinations of persons detained by the Police (Journal Of Laws 2012, item 1102), Regulation of the Minister of Health and Social Welfare of 6 May 1983 on the conditions and method for testing the body’s alcoholic strength (Journal Journal of Laws No 25, item 117) and in the Regulation of the Minister for Health of 21 December 2006 on the types and scope of medical documentation in healthcare institutions and the method of processing it (Journal of Laws No 247, item 1819, as amended). The subject-matter of the contract covers the provision of medical services 24/7 for detainees brought by officers, provided that they are provided regardless of the day of the week.
2. The Contractor undertakes to provide the following medical services to persons detained by the Contracting Officers in the following areas:
(a) conducting a medical examination of a detained person meeting the conditions laid down in Section 1 of the Regulation of the Minister for the Interior of 13 September 2012 on medical examinations of persons detained by the Police (Journal of Laws 2012, item 1102) and intended to be placed in the detainees’ room, issuing a medical certificate stating the absence or existence of medical contraindications for the detained person to be present in the detention room, together with the reasons therefor, and wounding and prescribing the necessary medication.
(b) taking blood (without an analytical test) from the detained person and compiling a blood donation protocol.
3. The quantity of services provided was accepted by the contracting authority with an estimate in order for the contractor to calculate the price of the tender and cannot give rise to claims on the part of the contractor in the event of fewer orders during the performance of the contract.
4. The contractor will be obliged to perform the subject-matter of the contract throughout the day, apart from the order resulting from the procedure for admission of patients (excluding admissions to patients whose life is at risk), in a facility the equipment and devices of which comply with the requirements laid down for medical establishments by the minister responsible for health.
5. The tests covered by this contract shall be carried out by the Contractor by the Contracting Officers on the basis of a written request from the on-call police unit carrying out the detention and, in the event of apparent injury or loss of consciousness, at the oral request of the officer.
6. The provision of medical services is permitted within the administrative boundaries of districts, while for the Provincial Police Headquarters/KMP in Radom within the administrative boundaries of Radom district defined as part of the contract.
7. The contracting authority shall allow part of the contract to be subcontracted to the contractor.
In this case, the contractor is obliged (pursuant to Article 36b of the Act) to include information on subcontracting in the tender. The absence of this information in the tender will mean that the contractor will not use subcontracting for the performance of the contract on the day on which tenders are submitted.CPV – Common Procurement Vocabulary: 85120000-6.3.
