Description

1. The subject of the order is the successive delivery of paper for printers and plotters. 2. Deliveries will be carried out successively, in batches depending on the current needs of the Ordering Party. 3. Detailed quantitative specification, detailed description of the subject of the contract (hereinafter: ‘OPZ’) is set out in Annex 1A to the SWZ, which is also a form for calculating the offer price. 4. The draft provisions of the contract are also an integral part of the GIP (Annex 4 to the SWZ). 5. The execution of each order should take place no later than 14 days from the receipt of the order. 6. Equivalent materials and equipment: 1) If the description of the subject of the contract includes any trademarks, patents or origin, sources or specific processes that characterize the products or services provided by a particular Contractor, the Contracting Authority shall allow equivalent solutions (‘or equivalent’ – Article 99(5) of the Public Procurement Act). They concern all the elements/components of the description of the subject-matter of the contract in this procedure which are required of the Contractor. When preparing the description of the subject-matter of the contract in the present proceedings, the contracting authority indicated all the cases known to it and, in each of them, provided the principles for assessing equivalent solutions. If the Contractor finds/notes, when analysing the description of the subject-matter of the contract, that these are not all cases, the Contractor is asked to provide the Contracting Authority with this information immediately/before the deadline for submission of tenders, indicating it in the request concerning the description of the subject-matter of the contract and the rules for assessing equivalent solutions; 2) The rules for assessing equivalent solutions in the present proceedings cover the scope of examination and evaluation of tenders, where failure to complete all elements of this description may be the basis for rejecting the tender (Article 226(1)(5) of the Public Procurement Act); 3) The rules for assessing the equivalent solution will also apply during the performance of the contract, where in the event of an intention to introduce an equivalent solution during the performance of the contract (the Contracting Authority or the Contractor) provided for in this SPC and the description of the subject matter will determine, inter alia, whether the Contracting Authority may allow an equivalent solution or not (Article 455(1)(1) of the Public Procurement Act); 4) Offering solutions equivalent to those indicated in the description of the subject of the contract additionally requires demonstrating that the offered solution is equivalent with technical, operational and usage parameters not worse than required by the Contracting Authority. The burden of proving compliance with these requirements lies with the Contractor in the tender submitted or, if this is the case during the performance of the contract, at the time when such a change becomes necessary; 5) If the rules indicated above are applied during the performance of the contract, they may occur provided that these changes do not affect the subject of the contract offered in the offer and the effect outlined in this SWZ. These must also be favourable cases (reduction of purchase and operating costs) for the Ordering Party. It is the responsibility of the party requesting such an equivalent solution (during the performance of the contract, the Contracting Authority or the Contractor) to justify this case in writing. However, they may not change essential elements of the offer or contract, for example: extension of the deadline for implementation, increase in remuneration; 6) The Contractor who refers to equivalent solutions described in accordance with the rules indicated in point 2) above must additionally demonstrate in the tender / during the performance of the contract that the supplies offered by him meet all the requirements specified by the Ordering Party in the content of the SWZ and other documentation of the procedure; 7) Demonstration that the solutions offered by the Contractor meet the requirements specified by the Ordering Party must take place in the submitted offer with detailed parameters of the proposed materials and devices and proof of circumstances resulting from previous records. The use of the above equivalent solutions also applies to cases where the description of the subject of the contract as a result of some oversight appeared indications referred to in this material. 7.
