1. Subject of the contract. 1.1 The subject-matter of the contract is the sale with delivery of a hydraulic downhole drilling rig with a compact hydraulic unit, together with assembly, a package of essential spare parts, commissioning and a functional test, hereinafter referred to as ‘the subject-matter of the contract’. 1.2 The subject of the contract will be intended for sealing, geological and exploration drilling, drilling of subsoiling, drainage, technical holes in rocks of various hardness, having a hydraulic drive, powered from a hydraulic unit. 1.3 Detailed conditions for the execution of the subject of the contract, the required technical parameters of the drilling rig and hydraulic unit can be found in Part III point. 3.3-3.6 of the Specifications of the Terms and Conditions available at: https://kopalniawieliczka.ezamawiajacy.pl 1.4 With the delivery of the subject of the order, the Ordering Party requires the delivery of a package of basic spare parts such as: jaws, hydraulic hoses, seals. 1.5 The subject of the contract must have a permit to work in the mining industry. 1.6 The subject-matter of the contract must comply with the requirements of the Geological and Mining Law Act of 9 June 2011 and its implementing provisions, in particular the Regulation of the Minister for Energy of 23 November 2016 on detailed requirements for the operation of underground mining plants and amending the Regulation of the Minister for State Assets of 19 June 2020 on detailed requirements for the operation of underground mining plants. 1.7 The subject-matter of the contract must meet the requirements of Directive 2014/34/EU of the European Parliament and of the Council of 26 February 2014 on the harmonisation of the laws of the Member States relating to equipment and protective systems intended for use in potentially explosive atmospheres, as implemented by the Act of 13 April 2016 on conformity and market surveillance systems (Journal of Laws of 2016, No. U. of 2021, item 514) and the Regulation of the Minister for Development of 6 June 2016 on requirements for equipment and protective systems intended for use in potentially explosive atmospheres) or the repealed Directive 94/9/EC of the European Parliament and of the Council of 23 March 1994 on the approximation of the laws of the Member States concerning equipment and protective systems intended for use in potentially explosive atmospheres, as implemented by the Regulation of the Minister for the Economy of 22 December 2005 on essential requirements for equipment and protective systems intended for use in potentially explosive atmospheres. 1.8 The subject of the contract must belong to Group I and at least category M2 within the meaning of the Regulation referred to in point 3.10 (equipment and protective systems intended for use in potentially explosive atmospheres). 1.9 The subject of the contract should meet the requirements of the Regulation of the Minister of Economy of 21 October 2008 (Journal of Laws No. Journal of Laws 2008, No 199, item 1228) on essential requirements for machinery. 1.10 The subject of the contract should meet the requirements of the Regulation of the Minister of the Environment of 29 January 2013 (Journal of Laws No. Journal of Laws 2015, item 1702) on natural hazards in mining plants (as amended). 1.11 The subject of the contract must have technical and operational documentation (electrical, mechanical, hydraulic parts). 1.12 The subject of the contract must bear the CE marking. 1.13 The subject-matter of the contract should be adapted to work in mining excavations of grades ‘a’, ‘b’ or ‘c’ of the methane explosion hazard. 1.14 The subject of the contract must have a certificate of inspection of the device. 1.15 As part of the implementation of the subject of the contract, the Contractor will be present free of charge at the reception of the device after its installation in the mining excavation and commissioning. 1.16 As part of the performance of the subject of the contract, the Contractor shall provide training in the assembly and handling of the delivered subject of the contract to designated employees of the Contracting Authority and shall issue an appropriate certificate from the training carried out. 2.
