1. The subject of the contract is the repair of maintenance level P4 33 (thirty-three) electric multiple units series EN57AKM (ETZ), which in the years 2013-2014 underwent repairs in maintenance level P5. In all provisions of the FTZ and its annexes, which refer to standards, technical assessments, technical specifications and technical reference systems, in accordance with Art. 4 of the Public Procurement Law Act, the Contracting Authority allows the use of solutions equivalent to those described in standards, technical assessments, technical specifications and technical reference systems, indicated in the FTZ and annexes if they allow to obtain features or parameters not worse than those referred to in the FTZ and annexes. If equivalent solutions are applied, the Contractor shall prove in the tender, in particular by the means of evidence referred to in Articles 104-107 of the Public Procurement Act, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent. The contracting authority shall request the submission of the evidence referred to above (if any). If the Contractor fails to submit the evidence in question or the evidence in question is incomplete, the Contracting Authority shall, in accordance with Article 107 para. 2 of the PPL Act will request the Contractor to submit or supplement the evidence referred to above (if applicable), subject to the provisions of Art. 3 of the PPL Act. 4. The Contracting Authority shall require the Contractor to provide a quality guarantee for a period of at least 12 months, counting from the date of signing the protocol of commission acceptance of a given electric multiple unit, for each entire EZT after repair in the maintenance level P4. 5. The contracting authority requires the completion of the contract in 2026-2027. 6. The Ordering Party requires the repair in the maintenance level P4 of each electric traction unit along with the execution of additional works and additional works - modernization, referred to in paragraph. 1 (1) to (3)), within a period of not more than 60 calendar days from the date on which the electric multiple unit is handed over for repair.
