Description

1. The subject-matter of the contract is the supply, together with instructions, of teaching equipment – a laser tachometer – to the Mechanical Department as part of the project entitled: Refurbishment of the B1 building in the building complex of Wrocław University of Technology, together with the modernisation of the teaching infrastructure of the B1 and B2 buildings.
2. The detailed scope of the obligations relating to the performance of this subject-matter of the contract is set out in the model contract, which constitutes Annex 2 to the ToR.
3. A detailed description of the subject-matter of the contract is set out in Annex 5 to the ToR.
4. The Contractor shall bear all costs relating to the delivery and the job instruction. The instructions will take place at the Contractor’s premises.
5. Additional information:
— Paragraph 1(9) of the model contract: Test time for equipment – means the period from the end of the installation, installation and start-up service until the contracting authority signs a report confirming the delivery. This period may be a maximum of 3 days;
— Paragraph 7(5) of the model contract: If the acceptance of equipment and services has not resulted in a finding that the Equipment and Services function properly and that the Equipment and Services comply with the specifications of the Contract, the Parties shall draw up a list of defects in accordance with Annex 6. The supplier undertakes to remedy the defects specified in the List of defects within 7 working days of the date on which the list of defects was drawn up. After the defects (deficiencies) have been rectified and after the acceptance of the equipment and services has been successfully completed, the Parties shall draw up a report confirming the delivery;
— Paragraph 8(2) of the model contract: In the event of delay in repairing the subject matter of the contract for more than 14 days, the Contracting Authority shall be entitled to have the equipment repaired by another entity and the costs of the repair shall be borne by the Supplier;
— point 7 of Annex 3 to the model contract: Repair time within the meaning of point 6 is a maximum of 14 days from the date on which the Contracting Authority sends the Service Notification by fax.
6. For the subject-matter of the contract, the contractor must provide (without additional payment by the Contracting Authority) at least one service inspection per year of the guarantee.
7. The tender must be unambiguous and comprehensive, i.e. cover the entire range of the subject-matter of the contract. The subject-matter of the contract must be complete with all the components, parts and materials necessary for commissioning and use. The subject of the contract offered must meet the requirements of the Contracting Authority.
8. The contractor must clearly identify the apparatus offered in the tender (Annex 5 to the ToR) by indicating, for example: on a specific product, the name, the designation of the trade mark, the name of the manufacturer and other characteristics attributed exclusively to that product.
9. The description of the apparatus offered should not give rise to any doubts on the part of the Contracting Authority. It must be apparent from the description that the subject-matter of the contract offered has the same parameters as those required by the Contracting Authority or better by indicating precisely the parameters of the apparatus offered. The equipment supplied must bear the CE safety mark and meet the health and safety and health requirements.
10. The contracting authority shall allow equivalent tenders to be submitted for the indication of trademarks, patents or origin, but the standards, parameters and standards of the equipment specified by the contracting authority must be observed. The parameters of the subject-matter of the contract (including the duration of the guarantee) are the minimum technical and qualitative minimum expected by the Contracting Authority and will form the basis for the assessment of any equivalent tenders. Equivalent apparatus offered by tenderers must have no lower parameters than those indicated in the description of the subject-matter of the contract. A contractor who invokes equivalent solutions described by the Contracting Authority must prove that the supplies it offers meet the requirements laid down by the Contracting Authority.
11. The contracting authority requires that the subject-matter of the contract be new, manufactured after 1 January 2012.
12. The contracting authority shall request that the proportion of the contract which the Contractor intends to subcontract should be indicated in the tender. Lack of information will mean that the Contractor will execute the contract himself.

14. Time limit for performance of the subject-matter of the contract: up to 60 days from the date on which the order was placed.
