Description

1. Under the contract entitled: ‘Illuminating the Buczkowice Commune’, the Contractor will be obliged to supply and install lighting fixtures and lighting system elements in order to modernise the lighting of public roads in the Buczkowice Commune. 2. The contract shall provide in particular for: 1) supply of lighting fixtures ; 2) disassembly of existing luminaires; 3) adjusting the booms to the account according to the lighting design, including lifting some booms above the line; 4) arrangements with the operator Tauron Nowe Technologie for the scope of work and switching activities; 5) carrying out works under the supervision of Tauron Nowe Technologie – meeting the parameters, to the extent and under the conditions described in Annex 8 to the SWZ – Description of the subject of the contract, which includes: Geolocation map of lighting points, List of retrofitted lighting, List of booms, List of control boxes, List of TRAFO stations, Technical documentation - Photometric design, Measurement (subsidiary). 3. Equivalence clause: 1) The Ordering Party, in accordance with the provisions of Art. 5 and Article 101 para. 4 of the Public Procurement Act, allows equivalent solutions for supplies, works, materials, systems meeting the requirements specified in the procurement documents. The Contracting Authority stipulates that wherever trademarks, patents or the origin of devices or materials are indicated in the description of the subject-matter of the contract in the wording of the CVT or in Annex 8 to the CVT – Description of the subject-matter of the contract, they should be treated only as proposals. The contracting authority accepts methods, materials, equipment, systems, technologies, etc. equivalent to those described in the description of the subject of the contract. It is therefore permissible to propose in the offer any equivalent market equivalents with properties not worse than those indicated by the Contracting Authority. The parameters indicated in the procurement documents shall specify the minimum technical, operational, operational, qualitative and functional conditions to be met by the subject-matter of the contract. The offer includes methods, materials, devices, systems, technologies, but with technical, qualitative and functional parameters. If the materials and/or equipment offered as equivalent by the Contractor are not equivalent in the light of the documents submitted by the Contractor, the Contractor's offer shall be rejected as not corresponding to the content of the RVU. In the case of describing the subject of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, the Contracting Authority allows the contract to be performed using solutions equivalent to those described. In this case, the procedure described in the preceding paragraph shall apply mutatis mutandis; 2. in the case of technologies, systems, materials or equivalent devices accepted by the Contractor for valuation, the tender must be accompanied by a list of these technologies, systems, equipment or materials, which will include in its content: the type and description of the technology or system used, the name of the equipment/material used, the name of the manufacturer, the precise and unambiguous type of equipment or material; 3) in addition, for equivalent technologies/systems/equipment/materials, the Contracting Authority requires proof of equivalence, including by means of technologies/systems/equivalent devices/materials attached to the list; calculations, detailed technical drawings, attestations, approvals, declarations of compliance with regulations and standards and data sheets of manufacturers of equipment/equivalent materials. These documents must unequivocally state the equivalence of the proposed technologies/systems/equipment/materials; 4) in the event of doubts as to the equivalence of the substitute technologies/systems/equipment/equivalent materials proposed in the tender, the Contracting Authority may require proof of equivalence. In particular, for this purpose, it may require the Contractor to provide catalogues of the manufacturer of the technology/systems/equipment/equivalent materials concerned.
