Description

The ordering party to conduct these proceedings in the name and on behalf of the State Treasury is: The Management Board of Residential Buildings in Suwałki TBS sp. z o.o., ul. Wigierska 32, 16-400 Suwałki. 1. The subject of the contract is the preparation of design documentation for the renovation of staircases and communication routes in the building at ul. Noniewicza 91 in Suwałki with accompanying robots. 2. The detailed subject-matter of the contract is set out in Annex No 2 to the FTZ – Description of the subject-matter of the contract, hereinafter referred to as the ‘OPZ’. 3. Due to the fact that the documentation prepared by the Contractor will constitute a description of the subject of the contract constituting an annex to the FTZ for the execution of construction works under the Public Procurement Law Act of 11 September 2019, the Contractor undertakes to prepare the documentation in such a way as to meet all the requirements of the Public Procurement Act. 4. The order must be executed in accordance with: 1) OPZ, 2) Regulation of the Minister of Development and Technology of 20 December 2021 on the detailed scope and form of design documentation, technical specifications for the execution and acceptance of construction works and the functional-utility program (Journal of Laws of 2021, No. U. item 2454). 3) Regulation of the Minister of Development and Technology of 20 December 2021 on the determination of methods and bases for preparing an investor's estimate, calculation of planned costs of design works and planned costs of construction works specified in the functional-utility program (Journal of Laws of 2021, No. U. item 2458), 4) By the Regulation of the Minister of Development of 11 September 2020 on the detailed scope and form of the construction project (Journal of Laws No. Journal of Laws 2022, item 1679, i.e. as amended), 5) applicable provisions of the Construction Law (Journal of Laws No. Journal of Laws of 2025, item 418, i.e.). - and other provisions: specific regulations, applicable technical conditions, state and industry standards, engineering arts, principles of technical knowledge, as well as other legal acts related to the subject of the contract. 5. The design documentation for the description of the proposed materials and equipment should be made in accordance with Article 99 of the Public Procurement Act. The subject-matter of the contract may not be described in such a way as to impede fair competition, in particular by indicating the trade marks, patents or origin, source or specific process which characterises the products or services provided by a particular economic operator, where this could lead to the preference or elimination of certain economic operators or products. Whenever in this FTZ the subject of the contract was determined by indicating trademarks, patents, origin, etc. the intention of the Ordering Party was to present the "type" of goods meeting the requirements of the Ordering Party. In addition, all such indications shall be deemed to be accompanied by the words 'or equivalent'. Therefore, it is permissible for the Contractor to offer an equivalent solution that will guarantee no worse parameters, technical-quality and functional standards than those indicated in the FTZ.
