Description

1. This contract covers the supply of medical devices divided into 2 parts. 2. A detailed description of the subject of the contract and the conditions for its implementation are set out in Annexes 7-1 to 7-2 and the draft provisions of the contract - Annex 6 to the FTZ. 3. The contract for both parts will be financed in the form of financial leasing, and the lessor will be selected in a separate tender procedure conducted by the Employer. The subject-matter of the present proceedings is not financial leasing. In the light of the above and in accordance with Article 7091 of the Civil Code, the Lessor selected by the Ordering Party in the subsequent proceedings will purchase the subject of the contract from the Contractor selected in these proceedings at a price consistent with the tender submitted by the Contractor and under the conditions set out in the FTZ, and the Contractor will sell the subject of the contract to the Leasing Party, while maintaining all the obligations of the Contractor towards the Ordering Party, including the principles and requirements of the Ordering Party set out in the FTZ and annexes. 4. Requirements for the subject of the contract: 1) the equipment offered must be brand new, unused, not remanufactured, must not come from exposure at points of sale, must be free from any physical and legal defects, 2) the equipment offered must meet the requirements imposed by law for release for free circulation and use, in particular bear the CE marking together with a declaration of conformity and a certificate of conformity for the equipment offered as a medical device, if applicable; 3) the IT solutions offered must comply with the applicable regulations, standards and standards, which concern the rules for the collection and processing of personal data and the exchange of health information in addition to Part 1 - supply of a digital x-ray apparatus: 1) the supply, installation and commissioning of a new digital X-ray machine with additional equipment and software, also includes works consisting of: construction of ceiling suspension on the ceiling based on the guidelines of the camera manufacturer, execution of floor ducts in AROT technology to connect the components of the camera, adjustment of the electrical installation in accordance with the requirements of the newly installed X-ray camera, rupture of the lining and location of the new electrostatic lining, repair of defects in places that require it after installing the camera and others in accordance with the provisions of Annex No. 7-1 to the SWZ and the knowledge obtained during the mandatory on-site inspection (chap. V SWZ) 2) elaboration of the project of permanent shields against X-ray radiation and execution of carton/gypsum wall restorations with lead sheet according to this project, 3) execution of acceptance and specialist tests after installation, 4) specification of the equipment and minimum requirements are set out in Annex 7-1 - and the draft provisions of the contract - Annex 6 to the SWZ; 5) implementation of the subject of the contract must take place in accordance with the applicable regulations and requirements for radiological equipment, medical devices and premises of health care units implementing medical procedures in the field of radiology - imaging diagnostics, 6) basic parameters and technical and functional features of the devices must comply with the requirements set out in legal regulations, in particular with: a) Regulation of the Minister of Health of 21 August 2006 on detailed conditions for safe work with radiological devices, b) Regulation of the Minister of Health of 11 January 2023 on conditions for the safe use of ionising radiation for all types of medical exposure. 1) the delivery, installation and commissioning of the ultrasound apparatus, 2) the specification of the equipment and the minimum requirements are set out in Annex 7-2 and the draft provisions of the contract - Annex 6 to the SWZ; 5. The order should be executed with due diligence, in accordance with all the requirements contained in the FTZ and possible information for the Contractors. 6. Any indication of trade marks, patents or the origin, source or specific process that characterises the products or services provided by a particular economic operator that may appear in the tender documentation serves only to define a standard and should be taken as an example only.
