The final amount of food options purchased under the law will depend on the Ordering Party's current needs and financial resources. 3. Food purchased under the option right must meet all the requirements as for a guaranteed order. 4. The contracting authority reserves that the part of the contract defined as the ‘right of option’ is an entitlement and not an obligation of the contracting authority. If the Ordering Party exercises the right of option, the Contractor shall be entitled to remuneration at unit prices as for a guaranteed order. 7. The Ordering Party guarantees placing orders under the basic order for the delivery of goods at the level of not less than 30% of the gross value of the Agreement referred to in § 4 sec. 4 of the model Agreement - constituting Annex 3 to the FTZ. The implementation of the Agreement in the remaining scope will depend on the actual needs of recipients resulting from the variable number of entitled to nutrition and the financial resources allocated for this purpose. 8. The Contractor shall not be entitled to any claims for compensation for failure to place and perform orders higher than 30% of the maximum gross value of the basic contract. 9.
