Providing musical instruments for educational activities within the College of Music "Sigismund Toduţă" Cluj-Napoca; Lot 1-piano type 1 - 9 pieces ; Lot 2-piano type 2 - 9 pieces; Lot 3-Marimba - 1 piece SUSPENSIONAL CLAUZA: The award/procurement procedure is initiated under this standstill clause, in the sense that the conclusion of the public contract is conditional on funds being secured by the principal authorising officer, the Municipality of Cluj-Napoca, and the contract is signed in compliance with the provisions on the commitment of expenditure from budgets falling under public finance legislation. Having regard to the provisions of Law 98/2016 and Government Decision No 395/2016, as amended, the Contracting Authority states that it will conclude the contract with the successful tenderer only to the extent that the funds necessary for the procurement will continue to be provided by the principal authorising officer. If, for whatever reason, the principal authorising officer will not grant the necessary funds, after receiving notification from him of the non-granting of the funding, the contracting authority reserves the right to cancel the award procedure, provided that there is no other source of funding, in accordance with the provisions of Article 212(1)(c) of Law 98/2016, as subsequently amended and supplemented, making it impossible to conclude the public procurement contract. Tenderers in this procedure understand that the Contracting Authority and/or the Principal Authorising Officer cannot be held liable for any damage in case of cancellation of the award procedure, regardless of its nature and regardless of whether the Contracting Authority and/or the Principal Authorising Officer have been notified of the existence of such damage. Tenderers in this procedure accept the use of the above special conditions/suspension clause, assuming full responsibility for any damage they may suffer in the situation described. The contract will enter into force only subject to the allocation of the necessary funds from the local budget to finance the object of the contract, by 31.12.2025 at the latest. If the necessary budgetary funds are not approved and allocated to the contracting authority by that deadline, the contract will not produce legal effects and neither party will be able to make claims for compensation or other financial claims in relation to it. The contracting authority undertakes to notify the economic operator within a maximum of 5 working days from the date of expiry of the time limit for the allocation of funds, of the fulfilment or non-fulfilment of the standstill condition.
