I-Vasto: Banking services

An open invitation to tender is intended to award to the sole tenderer who has submitted the best tender the assumption of 1 (one) loan agreement with charges borne by the State, for a period of fifteen years, to be settled in instalments with a ministerial commitment from 2011 to 2025, partly at a variable rate and partly at a fixed rate, for the following intervention:
1. ‘Completion of the Diga di Ponte Chiauci on the river Trigno – prog. A/G.C. No 138’; estimated net amount of EUR 5 000 000, a total contribution not exceeding EUR 6 824 098,75. The assistance is intended for investments relating to the National Centro Sud Plan allocated to the Consorzio di Bonifica Sud under Article 2 (133) of Law 244/2007, by CIPE Decision No 92 of 18.11.2010 and by Decree No 6424 of the Ministry of Agricultural, Food and Forestry Policy, in agreement with the Minister for Economic Affairs and Finance of 17.5.2012, registered by the Court of Auditors on 18.7.2012 in register 8 sheet 152, note No 848 of 13.12.2012 authorising the Ministry of Agricultural, Food and Forestry Policy to apply this invitation to tender – former AGENSUD – Commissioner ad acta.
The conditions for the provision of the service are set out in the draft loan agreement annexed to the tender specifications and approved by the Ministry of Economic Affairs and Finance by letter No 69888/12 of 6.9.2012, which cannot be amended or corrected, except those, in any event non-essential, which will be communicated or agreed with the Ministry of Agricultural, Food and Forestry Policy before the conclusion.
In the light of the provisions of letter No 576 of 10.8.2012 from the Ministry of Agricultural, Food and Forestry Policy – formerly AGENSUD – Commissioner ad acta, the successful tenderer must accept that the validity of the loan agreement is subject to approval by the Ministry, once all its details have been finalised and forwarded to it by the contracting consortium.
The Consortium reserves the right to withdraw this procedure in the event of an overriding need in the public interest, or to cancel it in cases of law, and not to award the contract pursuant to Article 81 (3) of Legislative Decree No 163/2006, as amended, if no tender proves to be advantageous or suitable in relation to the subject matter of the contract; in any event, the competitor will not be able to claim any form of compensation, compensation or indemnity in any way whatsoever.
