Description

1. The subject of the contract is the supply of traction batteries, tyre accumulators and spare parts for handling equipment and lifting equipment. according to the order documents. 2. The description of the subject-matter of the contract is set out in Annex 4 to the SWZ – Operational and Technical Requirements (WET). 3. The type (assortment) and quantity of the individual assortment (subject of the contract) are set out in Annex 2 to the FTZ – Price form. 4. The tendered subject of the contract must meet the requirements set out in Annex 4 to the FTZ – Operational and Technical Requirements (WET) as well as in Annex 3 to the FTZ – Draft provisions of the contract (hereinafter PPU). 5. The conditions for the performance of the contract are set out in the draft provisions of the contract constituting Annex 3 to the FTZ. 6. The contractor will provide a guarantee for the subject-matter of the contract for the period and under the conditions set out in §7 PPU – Annex 3 to the FTZ. 7. The contracting authority does not provide for the possibility of exercising the right of option. 8. The delivered subject of the contract should be new, of first quality (I category, I grade), free from physical and legal defects, unused, not regenerated. 9. The customer accepts partial deliveries. 10. The contracting authority shall not require the contractor to submit with the tender any such means of proof. 11. The Ordering Party does not require the lodging of a security. 12. The Contracting Authority shall not require the lodging of a security for the proper performance of the contract.
