Description

1. The subject of the contract is the provision of ticket control services and transport documents on trains operated by Warsaw Commuter Railway sp. z o.o. 2. A detailed description of the subject-matter of the contract is attached as Annex 2 to the FTZ, in which the Ordering Party specified the maximum scope of the subject-matter of the contract, subject to para. 3. 3. The Ordering Party reserves the right to exercise the Optional Right: 1) The Ordering Party indicates that the minimum scope of the subject of the contract, hereinafter referred to as the basic scope, concerns the performance of the subject of the contract referred to in paragraph. 1 FTZ and the Description of the Subject of the Order constituting Annex 2 to the FTZ for a period of 12 months from the date of commencement of the service; 2) The contracting authority states that the right of option, hereinafter referred to as the ‘Option Law’, covers the performance of the subject-matter of the contract referred to in paragraph 2. 1 FTZ and the Description of the Subject of the Order constituting Annex 2 to the FTZ for the next 12 months following the basic scope. 4. The right of option will be exercised provided that the Ordering Party has financial security. The condition for the exercise of the option right is that the Employer delivers to the Contractor a declaration of intent regarding the exercise of the option right to the extent specified by him. The Ordering Party shall, after 6 months from the commencement of the basic order, submit a statement on the exercise of the Option Law. 5. If the Employer does not exercise the right of option, the Contractor shall not be entitled to any claims in this respect. The Ordering Party reserves that it is not obliged to exercise the right of option. 6. The Contractor is obliged to execute the order on the terms and conditions described in the draft provisions of the contract (PPU) constituting Annex 4 to the FTZ. 7. The contracting authority shall not divide the contract into lots and shall not allow partial tenders to be submitted. 8. The main subject of the contract in this proceeding is a service within the meaning of Art. 28 of the PPL.
