The Kaufmänische Krankenkasse – KKH (‘KKH’) aims to conclude discount agreements with all appropriate pharmaceutical companies pursuant to Section 130a(8) of the SGB V for the above active ingredients/active substance combinations in the context of a so-called ‘open house procedure’. Subject to uniform contractual conditions and a uniform access procedure, all appropriate and interested pharmaceutical undertakings or groups of pharmaceutical undertakings are offered access to a discount agreement pursuant to § 130a(8) SGB V on the above active ingredients/active ingredients combinations. Interested pharmaceutical companies may request the participation documents and the contract from the contact address under l.1 above. At the same time as the contract documents are requested, it must be demonstrated that the pharmaceutical company holds appropriate marketing authorisations for medicinal products containing the above active ingredient. Evidence may be provided, for example, by means of an extract from the AMIS database. In order to conclude a contract, the interested pharmaceutical company must submit the requested participation documents in full and signed. A contract will be concluded with each pharmaceutical company that fulfils the eligibility criteria. There is no exclusivity. Accession or conclusion of the contract may take place at any time and under the same conditions. Individual contractual negotiations are not carried out. Should KKH organise a tender for exclusive contracts in the form of an open procedure for the active substances during the contract period, the contracts concluded in the context of this publication will be terminated in accordance with the contractual provisions.
This publication does not constitute the award of a public contract within the meaning of the Procurement Coordination Directive, e.g. public procurement law. In order to ensure the greatest possible degree of transparency with regard to the envisaged conclusion of contracts, it is published in the Supplement to the Official Journal of the European Union. In the absence of a corresponding publication form, the contract notice will be used. The resulting conceptual requirements, such as the term ‘open procedure’, are solely due to the use of this notice form and the publication platform. There is no other significance, in particular a submission to public procurement rules, to the extent that they are not legally obliged to do so.
