Description

1. The subject of the order is the delivery of servers and racks with warranty, installation and technical support divided into 3 parts: part 1 - Delivery, installation and installation of rack cabinets with accessories and warranty for 60 months, part 2 - Delivery of a Tool Platform consisting of 16 pieces of servers (2 x 8 pieces each) and Software with installation and technical support and warranty service for 60 months, part 3 -. Delivery of 12 pieces of type A servers, 88 pieces of type B servers, and 6 pieces of type C servers with assembly and technical support and warranty service for a period of 60 months. 2. The subject-matter of the contract is described in detail in Chapter II of the SWZ – Description of the subject-matter of the contract. 3. Pursuant to Article 139 of the Public Procurement Act, the contracting authority provides for the reverse order of the evaluation of tenders, i.e. it will first examine and evaluate the tenders and then select the contractor whose tender was the highest scored in terms of the lack of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 4. The Ordering Party is the administrator of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as "GDPR"). 5. The Contractor submits a tender via the eProcurement Platform of the Public Procurement Office - https://ezamowienia.gov.pl/pl/. 6. The Contracting Authority reserves that it may cancel the procurement procedure if the public funds that the Contracting Authority intended to allocate to finance the contract are not awarded to it. 7. The tender shall be submitted, failing which it shall be null and void, in electronic form, in accordance with the requirements strictly laid down in the SWZ. 8. The Contracting Authority will not award the contract if the circumstances referred to in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning organisational measures in connection with Russia's actions destabilising the situation in Ukraine (Journal of Laws No. Urz. EU No L 229/1 of 31.7.2014) and will exclude the Contractor if one or more of the grounds for exclusion set out in Article 7 para. 1 of the Act of 13 April 2022 on special arrangements for counteracting the support for aggression against Ukraine and for the protection of national security (Journal of Laws No. Journal of Laws 2023, item 1497, as amended) – in order to confirm the absence of grounds for exclusion, a declaration constituting Annex 8 to the Tender Form must be submitted together with the tender. In the case of joint procurement, the declaration shall be submitted by each of the Contractors. 9. The Contractor undertakes to perform the subject of the Contract within the following time limits: 1) within the scope of Part 1 – Delivery, installation and installation of RACK cabinets with accessories and warranty for 60 months: a) delivery of 6 Rack Cabinets to the location indicated by the Ordering Party within 45 (constitutes a criterion for the evaluation of offers) working days from the date of signing the contract; b) installation, execution of the supply installation for the Cabinets, as-built documentation within 10 working days from the date of signing the Quantitative Acceptance Protocol; c) The Contractor will provide the manufacturer's warranty service for Wardrobes with equipment for 60 months from the date of signing the Quality Acceptance Protocol. 2) in the scope of Part 2 - Delivery of a Tool Platform consisting of 16 pieces of servers (2 x 8 pieces each) and Software along with assembly and technical support and warranty service for 60 months: a) Delivery of the Tool Platform within 50 Working Days from the signing of the Agreement, including: - Delivery of two new Sets of Equipment to the Customer's location within 45 working days from the date of conclusion of the contract, ended with a quantitative acceptance protocol. - Delivery of Tool Platform Software, Storage Virtualization Software, Computing Power Virtualization Software and Management System Software within 50 Business Days from the date of conclusion of the contract, completed with a quantitative acceptance protocol. b) Installation and commissioning of Device Sets and Installation and configuration of the delivered Software up to 5 Business Days from the delivery of Device Sets, completed with a qualitative acceptance protocol. c) Execution of as-built documentation within 10 Business Days from the completion of the Installation and configuration of the Software completed with a qualitative acceptance protocol. d) The Contractor is obliged to provide the Ordering Party with a warranty service for Tool Platform Devices, implemented by the manufacturer of Devices and Technical Support of the Software implemented by the manufacturer of the Software for 60 months from the date of signing the qualitative acceptance protocol. 3) within the scope of Part 3 - Delivery of 12 pieces of type A servers, 88 pieces of type B servers, and 6 pieces of type C servers with assembly and technical support and warranty service for a period of 60 months: a) The Contractor shall carry out the delivery of: - 12 pieces of Type A Devices - 6 pieces for each of the Locations, within 45 working days from the date of conclusion of the contract; - 88 units of Type B Devices - 44 units for each of the Locations, within 45 working days from the date of conclusion of the contract; - 6 pieces of Type C Devices - 3 pieces for each of the Locations, within 45 working days from the date of conclusion of the contract; b) Assemble Type A Devices, Type B Devices, Type C Devices in Rack Cabinets up to 15 Working Days from the date of signing the Quantitative Acceptance Protocol; c) The Contractor is obliged to provide the Ordering Party with technical support of the Software and warranty service for 60 months, from the date of commissioning of the Devices and signing the Quality Acceptance Protocol.
