Record from SWZ: 4. 4.1 The subject-matter of the contract is ‘Service for the collection and management of municipal waste from owners of residential properties and PSZOK from the territory of the commune of Gruta in the period from 1 January 2026 to 31 December 2026’. 4.1.1. The scope of the contract includes: 1) collection of unsorted (mixed) municipal waste from owners of inhabited real estate, 2) collection of separately collected municipal waste from owners of inhabited real estate: 3) collection and management of municipal waste delivered by residents to the Selective Municipal Waste Collection Point (PSZOK), 4.1.2. The service also includes: 1) equipping real estate with residential buildings in containers in quantities and sizes consistent with the description of the subject of the contract (OPZ – Annex 1 to the tender specifications) The detailed description of the subject of the contract is contained in Annex 1 to the tender specifications 4.2 The contracting authority does not allow partial tenders to be submitted. The contracting authority shall not divide into lots for the following reasons: The Contracting Authority is not in a position to determine technically how and to what extent different Contractors could perform the above-mentioned subject of the contract. The fact that this contract is not divided into lots does not affect the availability of small and medium-sized enterprises on the market. Any company operating in the waste management market has access to this contract. 4.3 The contracting authority does not allow variants to be submitted. 4.4 The Contracting Authority provides for the possibility of awarding the contracts referred to in Art. 1 point 8 of the PPL Act. 3.1. The contracting authority provides for the award of a contract consisting in the repetition of similar services, as referred to in Article 214(1)(7) of the Public Procurement Act. 3.2. Scope of services to be provided: the contracts will consist in the repetition of similar contracts as the basic contracts and will be consistent with the subject of the basic contract, i.e. covered by the open tendering procedure described in Annex 1 of the FTZ. 3.3. The contracting authority provides that the value of the contract to be awarded may be up to 50% of the value of the basic contract. 3.4. Conditions under which the contract (repetition of similar services) will be awarded: -in the event of exhaustion of the amount referred to in § determining the value of the contract -in the case of a prolonged procedure for the award of a subsequent contract in an open procedure, which should also be understood as a failure to resolve the procedure in such a procedure, -the award of the contract will be preceded by a direct procedure, after negotiations with the Contractor. 3.5. The Contracting Authority does not provide for an obligation to carry out an on-site inspection or require the submission of a tender after the on-site inspection or verification by the Contractor of the documents necessary for the performance of the contract referred to in Article 131 sec. 2 of the PZP Act. However, if the Contractor wishes to carry out a local vision or familiarize himself with the documentation on the spot with the Contracting Authority, he should contact the persons designated to communicate with the Contractors for this purpose. 3.6. The Ordering Party does not provide for settlements in foreign currencies. Settlements between the Ordering Party and the future Contractor will take place in Polish zlotys. 3.7. The contracting authority does not provide for reimbursement of the costs of participation in the procedure. 3.8. The Contracting Authority shall not impose an obligation on the Contractor to perform the key tasks of the contract in person, in accordance with Articles 60 and 121 of the Public Procurement Act; 3.9. The contracting authority does not provide for the conclusion of a framework contract. 3.10. The Ordering Party does not provide for an electronic auction. 3.11. The Ordering Party does not allow the submission of tenders in the form of electronic catalogues or the attachment of electronic catalogues to the tender, in the situation referred to in Article 93 of the Public Procurement Act. 3.12 Common Procurement Vocabulary (CPV) names and codes describing the subject of the contract: Main subject: 90500000 - 2 - waste services; 3.13.Additional item: 90513100 - 7 – services for the export of household waste. 3.14. Requirements for the employment, on the basis of an employment relationship, of persons performing certain activities by a contractor, subcontractor or subcontractor. Pursuant to Article 95 of the Public Procurement Act, the contracting authority requires the contractor to employ, on the basis of an employment contract, persons performing activities within the scope of contract performance, the performance of which includes the characteristics of the employment relationship specified in Article 22(1) of the Labour Code Act of 26 June 1974 (Journal of Laws 2023, item 1465). The method of verifying the employment of these persons and the contracting authority's power to control the contractor's compliance with the above requirements and the penalties for non-compliance with these requirements are set out in the draft provisions of the contract annexed to the FTZ. 1) The scope of responsibilities of persons performing activities in the scope of contract performance: a) the driver of the ‘garbage truck’ – independent, daily maintenance of the garbage truck’s car, circulating on public roads in compliance with road traffic law, collecting and exporting municipal waste in compliance with health and safety regulations, washing and disinfecting waste containers and the garbage truck’s car, b) the driver of the ‘hacker’ car – independent, technical maintenance of the vehicle, circulating on public roads in compliance with road traffic law, collecting and exporting municipal waste in compliance with health and safety regulations, unloading municipal waste from the container, At the latest on the date of signing the contract, the Contractor shall submit to the Contracting Authority a declaration on compliance with the requirement set out in point 3.14. 5. DATE OF IMPLEMENTATION OF THE ORDER Order completion date: 12 months.Planned date of commencement of implementation of the subject of the contract 01.01.2026, planned end date 31.12.2026.
