Description

The subject of the contract is the purchase of: a) PART I - 8 (eight) brand new, urban, zero-emission hydrogen-cell buses, single-unit, with a length of 11.5 - 12.5 m, intended for public transport. Each of the offered buses will be brand new, which means that it will be manufactured not earlier than 6 (six) months before the date set in accordance with point 4 of the SWZ and with a mileage according to the meter not greater than 500 km. The buses offered must be of one brand, identical in terms of construction, technical parameters and completion and equipment. (b) PART II - 2 (two) units of brand new, urban, zero-emission hydrogen-cell buses, with a length of 17.5 - 18.5 m, intended for public transport. Each of the offered buses will be brand new, which means that it will be manufactured not earlier than 6 (six) months before the date set in accordance with point 4 of the SWZ and with a mileage according to the meter not greater than 500 km. The offered buses must be of one brand, identical in terms of design, technical parameters and picking and equipment. The contracting authority requires that the offered type of bus in both Parts I and II be implemented in series production, i.e. it is not a prototype or a unit product. The subject-matter of the contract includes the award by the Contractor of a partial (internal) authorisation or authorisation for entire vehicles to carry out maintenance and repair work on the offered type of vehicle together with training of the Contracting Authority's employees in the field of day-to-day operation and repairs of the bus (electrical, mechanical and bodywork). The exceptions are inspections and servicing of the hydrogen system, which the Contractor will be obliged to perform during the full truck warranty period. If the Ordering Party is unable to perform repair work on its own, it will ask the Contractor or the Authorized Service Station indicated by the Contractor for assistance in completing the repair, during the warranty period and beyond. The Seller shall train the Buyer's employees free of charge in the field of economic driving, operation and repair of the bus at the date and place agreed with the Buyer, no later than within 7 days from the date of issue of the first bus: a) if a tender is submitted for Part I, 26 employees, including 16 drivers, 8 workshop employees (including training in the construction and repair of buses and G1 and G3 Electrical and Gas ratings Operation + Supervision), 2 technical staff), b) if a tender is submitted for Part II, 10 employees, including 4 drivers, 4 workshop employees and 2 technical staff), c) if a tender is submitted for Part I and II, 36 employees, including 20 drivers, 12 workshop employees and 4 technical staff). The buses offered must meet all the requirements laid down by law and standards, in particular: a) have documents allowing its registration and operation in Poland, b) meet the requirements set out in the provisions contained in Section III of the Act of 20.06.1997. – Road Traffic Law (consolidated text, Journal of Laws 2024, item 1251), (c) meet the requirements set out in the Regulation of the Minister of Infrastructure of 31.12.2002 on the technical conditions of vehicles and the scope of their necessary equipment (consolidated text Journal of Laws of 2024, item 502 as amended), (d) must meet the technical parameters and requirements specified by the Ordering Party in point 11.4 of the SWZ. Before the final acceptance of the first bus, the Contractor shall submit to the Contracting Authority a Vehicle Type Approval Certificate issued by a legally authorized body within the meaning of the Regulation of the Minister of Infrastructure of 2 August 2023 on the type approval of vehicles (Journal of Laws, item 1651). The lack of an approval document will result in the refusal to accept the bus. The Contractor shall: a) grant a guarantee on the terms specified by the Ordering Party, b) grant the Ordering Party an unlimited in time and free of charge license for all software of devices that are equipped with the bus together with unlimited in time functionality of the software, c) deliver the subject of the order to the Ordering Party's headquarters on the terms of DDP according to Incoterms 2020. Warranty and warranty conditions (counting from the date of pick-up of each bus) - applies to Part I and Part II: a) guarantee and warranty for the entire bus for a minimum of 36 months without a limit of kilometers, b) guarantee for electricity storage for a minimum of 60 months, with a minimum number of charging cycles of not less than 3600 without a decrease in energy storage capacity of more than 20%, c) guarantee for motor / electric drive engines - 60 months, d) guarantee for hydrogen cell - 25 thousand operating hours, e) guarantee of durability of hydrogen tanks in terms of their usefulness - min. 15 years, f) guarantee for corrosion perforation of external seams and body frame and chassis without the need for additional maintenance during operation minimum - 144 months, g) guarantee for paint coatings - minimum 72 months, h) guarantee for durability of construction and plating (breakage of the frame structure and durability of connections of body and chassis components) - minimum 72 months, i) guarantee for the possibility of purchasing all spare parts for the bus, its structures, assemblies, subassemblies, devices, etc. 15 years. Proceedings shall be conducted in accordance with the rules provided for in the reverse procedure referred to in Article 139 para. 1 of the law.
