Description

The subject of the contract is the supply of food under the name “Food 2/2025” for the student canteens of the ÚZ ŠDaJ STU in Bratislava in the sense of the required assortment , which is specified in Annexes 3.1 to 3.13 of the tender specifications . Estimated delivery of the subject of the contract: within 24 hours of the Buyer's delivered order to the place of delivery within the meaning of the Terms and Conditions set out in Section D (Annex 4) of the General Terms and Conditions, for a maximum period of 12 months from the entry into force of the Framework Agreement or until the financial volume specified in point 43.2 of the General Terms and Conditions is exhausted, whichever is the earlier. The subject matter of the contract includes related services related to transport to the place of delivery, loading and unloading of the delivered goods to the place of delivery. The quantities of each type of goods will be specified by regular orders. The contracting authority reserves the right to consider the quantities envisaged as non-binding and, if necessary, to order quantities lower or higher than those envisaged. If the quantities ordered are lower than expected, the tenderer is not automatically entitled to be supplied with the full scope of the subject of the contract as defined in Annexes 3.1 to 3.13SP. Where the description includes particulars or references to a particular manufacturer, production method, brand, trade name, patent or type, the tenderer shall be allowed to submit a tender with an equivalent specification, respecting all the parameters and requirements in the specification, or an equivalent with better characteristics, as indicated by the tenderer in Annex 9 to the SR - Proposal of Equivalents to that part of the subject-matter of the contract Nos 1 to 13, for which the tenderer has decided to submit a tender and to apply the Proposal of Equivalents. The tenderer shall ensure the delivery of the ordered goods in the agreed quantity, scope, quality, required technical parameters, in perfect condition and on the agreed date, by motor vehicles meeting hygiene requirements so as to ensure sufficient protection of the goods against their destruction, damage or deterioration, according to individual orders in accordance with the specification set out in Annex Nos.3.1 to 3.13 SP. The goods must be delivered in accordance with the agreed technical and functional characteristics, valid generally binding regulations of the Slovak Republic, technical standards and conditions required by the contracting authority. The tenderer is obliged to deliver the goods within the period within which no more than 1/3 of the period of consumption indicated on the delivered goods or on the delivery note has elapsed. The goods must not show signs of violation of packaging, moisture, there must be no impurities and must comply with all regulations corresponding to the Codex Alimentarius and in accordance with Act No. 152/1995 Coll. on foodstuffs, as amended, the relevant implementing regulations to this Act and other binding regulations. If objections are raised in review procedures against the contracting authority’s procedure by tenderers, the deadline for completing the performance of the subject-matter of the contract may be extended.
