Description

1. The subject-matter of the contract is the supply of endoscopic tools and accessories as described and required in Annexes 1A to 1L to these specifications. 2. The term of validity of the subject of the order may not be less than 12 months from the date of delivery. 3. The Contracting Authority reserves the right to ask the Contractors at the stage of examination and evaluation of tenders to provide samples of the offered subject of the contract in order to test and verify them 4. The other terms of the contract are set out in the draft contract, which is attached as Annex 3 to the FTZ. CONDITIONS FOR PARTICIPATION IN THE PROCEDURE AND THE WAY OF ASSESSING THE ASSESSMENT OF COMPLIANCE WITH THESE CONDITIONS Contractors who meet the conditions set out in Article 57 of the Public Procurement Act and Article 112 sec. 2 of the PPL Act, i.e.: 1) are not excluded 2) meet the conditions for participation in the proceedings, regarding: a) ability to trade - lack of b) entitlement to conduct a specific economic or professional activity - lack of c) economic or financial situation - lack of d) technical or professional ability - lack of 3. Contractors who are not excluded from the procedure pursuant to Article 108 of the Public Procurement Act and Article 109 sec. 1 point 1 and point 4 of the PPL Act and are not excluded from the proceedings pursuant to Article 7 sec. 1 of the Act of 13 April 2022 on special arrangements for counteracting support for aggression against Ukraine and protecting national security (Journal of Laws 2022, item 835), and are not subject to the prohibition on awarding or continuing to perform any public contract pursuant to Art. Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine Ooh, ooh, ooh. EU L 229, 31.07.2014, p. 1, as amended). 1. With regard to demonstrating compliance by the Contractor with the conditions referred to in Article 57 of the Public Procurement Act, the Contractor shall submit: a declaration of compliance with the conditions for participation in the procedure, signed by the person(s) authorised to represent the Contractor, as appropriate. The Contractor shall submit the relevant declaration in the form of a single document, constituting Annex 4 to the Specifications (SEA form); 2. In terms of confirming the absence of grounds for exclusion from the Proceedings in the circumstances referred to in Article 108 of the Public Procurement Act and Article 109 sec. 1 point 1 and point 4 of the PPL Act and Article 7 sec. 1 of the Act of 13 April 2022 on special arrangements for counteracting support for aggression against Ukraine and protecting national security (Journal of Laws 2022, item 835) and Art. Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine Ooh, ooh, ooh. EU L 229, 31.07.2014, p. 1, as amended), the Contractor shall submit: a declaration that there are no grounds for exclusion from the procedure – completed and signed respectively by the person(s) authorised to represent the Contractor. The Contractor shall submit a statement in the form of a single document, constituting Annex 4 to the Specifications (SEA form), b) a statement that the Contractor is not subject to exclusion from the procedure pursuant to Art. 1 of the Act of 13 April 2022 on special arrangements for counteracting support for aggression against Ukraine and protecting national security (Journal of Laws 2022, item 835) and is not subject to the prohibition on awarding or continuing to perform any public contract pursuant to Art. Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine Ooh, ooh, ooh.
