Description

Sykehusinnkjøp HF intends, on behalf of Helse Stavanger HF, to enter into a procurement contract with Diacor AS for the procurement of 1 complete equipment for indirec calorimetry type Q-NRG+ produced by COSMED, as well as a framework agreement for the procurement of accompanying equipment dependent consumables and spare parts. The equipment delivery shall include trolley with fixing plate, basket and fixing for calibration gas and necessary calibration equipment, necessary software, user training and technical review. The procurement agreement shall also include an option for the procurement of service at different levels and service courses. The framework agreement and the procurement agreement ́s options shall also cover the need for the Intensive Care Department at Helse Stavanger HF, which has procured equivalent equipment for indirect calorimetry through an option contract in another agreement. It is in the public procurement regulations § 13-4 first section letter b no. 2 that the contracting authority can hold a procurement without a competition if the procurement concerns services that only a specific tenderer can deliver because competition is impossible for technical reasons. The equipment shall measure how much oxygen a person consumes and how much carbon dioxide a person produces and, based on this, calculate a person's rest metabolism (REE). The equipment shall be used at different departments and must therefore be easy to move. The equipment shall also be used in patients with a home respirator, and it must therefore be possible to connect it to a respirator. The following minimum requirements are set for the equipment that shall be procured: The equipment shall be able to be used on both spontaneous breathing patients and mechanically ventilated patients, both for invasive and non-invasive ventilation. The equipment shall be able to be used with a home respirator, type Astral 150. The equipment must be able to carry out very precise measurements of oxygen consumption (O2) and carbon dioxide production (CO2) in order to calculate all the relevant metabolic parameters (REE, RQ etc.). Equipment with a monitor must be able to be operated with gloves. The contracting authority knows only one tenderer in the market who can fulfil the described intended use and at the same time fulfils all of these absolute minimum requirements for the equipment. This is also supported by completed market surveys, including a market survey published on TED, in which tenderers of equipment for indirect calorimetry were asked to register. Based on this, a competition cannot be arranged for the delivery of the equipment that shall be procured. This is due to technical reasons. The terms for procurement without competition in accordance with the public procurement regulations § 13-4 first section, letter b no. 2 are therefore fulfilled.
