Description

In accordance with the provisions of Art. 160 par. (2) of Law No. 98/2016, the contracting authority shall set a single deadline for requests for clarifications made by economic operators and to respond clearly and completely to all requests for clarifications/additional information that may be requested during the tender submission period. Considering the possibility of selecting the award procedure in ANAP’s ex-ante verification programme, when setting the deadline, account was also taken of the time needed for ANAP to verify the proposal for a reply in accordance with Article 8(2) of Government Decision No 419/2018: ‘The contracting authority shall send the proposal for a consolidated reply to requests for clarifications/additional information to ANAP at least 4 days before the deadline or, where applicable, the deadlines for reply set out in the contract notice/simplified contract notice/contest/concession notice.’ The number of days until which clarifications may be requested: 20 days before the closing date for submission of tenders. The contracting authority will respond clearly and completely to all requests for clarification, in accordance with Article 161(1) of Law No 98/2016, on the 11th day before the closing date for the submission of tenders. If these deadlines end on non-working days, the authority will reply on the last working day before that deadline.
