Description

As of 1 January 2025, the Päijät-Häme radiotherapy unit was transferred from HUS to the Päijät-Häme wellbeing services county as a business transfer. As a result of the transfer, the operations of the radiation therapy unit will continue in the same premises at Päijät-Häme Central Hospital, and the employees of the HUS radiation therapy unit transferred as old employees to the Päijät-Häme wellbeing services county. The Päijät-Häme radiotherapy unit has two radiotherapy machines (linear accelerator) with accessories. The machines are owned by the Päijät-Häme wellbeing services county and delivered by Varian Medical Systems Oy. The older device is called iX (v2011) and the newer Truebeam (v2020). In addition, the unit has (i) the radiotherapy information system ARIA provided by Varian Medical Systems Oy, which includes the software needed for the planning, implementation and monitoring of radiotherapy, and (ii) MVision AI Oy's artificial intelligence-based software for the automatic structuring of the TT images needed for dose planning. ARIA is tightly integrated into both radiotherapy machines and their peripherals. ARIA monitors and controls the operation of radiotherapy machines in real time in a treatment situation, and stores all the data produced by the machines in the patient's treatment history. The above-mentioned information systems were acquired for the Päijät-Häme Radiation Therapy Unit through contracts signed by HUS at a time when the operations of the Päijät-Häme Radiation Therapy Unit were organised by HUS. The transfer agreement includes an agreement on the use of ARIA in the Päijät-Häme wellbeing services county until 30 September 2025. Continuing uninterrupted full-scale operations in the Päijät-Häme radiotherapy unit requires a new acquisition and the conclusion of an agreement with ARIA. The contracting entity acquires the radiotherapy information system ARIA from Varian Medical Systems Oy under a contract valid until further notice. Varian Medical Systems Oy has submitted tenders dated 17.1.2025 and 28.1.2025 to the Päijät-Häme wellbeing services county, on the basis of which the procurement will be made. The procurement is carried out as a direct procurement in accordance with section 40(2)(2) of the Act on Public Procurement and Concession Contracts (Public Procurement Act, 1397/2016). Under Section 40(2)(2) of the Act on Public Contracts, a contracting entity may award a direct contract if, for technical reasons or reasons related to the protection of exclusive rights, only a particular supplier can carry out the procurement. An additional condition is that there are no reasonable alternative or substitute solutions and that the absence of competition is not due to an artificial narrowing down of the terms of the procurement. ARIA is the only information system that is fully compatible with both iX and True-beam machines, and Varian Medical Systems Oy is the only supplier that can supply this information system. Taking into account the existing Truebeam and iX care machines owned by the Päijät-Häme wellbeing services county, the legal obligation of the Päijät-Häme wellbeing services county to arrange radiotherapy services, as well as the need for the content of the information system determined by the contracting entity and the need for the implementation of patient care, there are no reasonable alternative or substitute solutions for the information system to be procured, and by implementing the procurement as a tendering procedure, it would be possible to receive other offers. The procurement is not a failure to take advantage of the conditions of competition, nor is the absence of competition the result of an artificial narrowing down of the terms of the procurement.
