The subject of the contract is the provision of services in the Commune of Skrwilno in the period from 01.01.2026 to 31.12.2026 in the field of collecting, transporting and managing municipal waste from owners of inhabited and uninhabited real estate on which municipal waste is generated and from real estate on which there is a cottage and other real estate used for recreational and leisure purposes from the Commune of Skrwilno. 2. The Contractor will be obliged to collect and manage the waste collected at the Selective Municipal Waste Collection Point located in Skrwilno, ul. Church of 43. 3. Required deadline for performance of the contract from 1 January 2026 to 31 December 2026. 4. Contractors who are not excluded for the reasons referred to in Art. 1 points 1-6 and Article 109 para. 1 point 4 of the Public Procurement Law Act, who meet the conditions referred to in Article 112(2) of the Public Procurement Law Act and who demonstrate their fulfilment at the level required by the Employer as described in the Terms and Conditions of the Contract. 5. The Contracting Authority informs that, in accordance with Article 95 of the Public Procurement Law Act, it requires the employment of persons performing activities directly related to the collection and management of municipal waste by the Contractor or subcontractor on the basis of the employment relationship. 6. Contractors may apply for the award of the contract if they meet the conditions relating to the criterion relating to: 1) the right to conduct a specific business or professional activity, if it results from separate provisions - the Employer specifies that the condition will be met if the Contractor proves that he has: a) an up-to-date entry in the register of regulated activities in the field of collecting municipal waste from owners in the Commune of Skrwilno in accordance with the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws No. Journal of Laws 2024, item 399 as amended); b) current entry in the BDO register kept by the competent Marshal of the Province pursuant to Art. 1 of the Waste Act of 14 December 2012 (Journal of Laws No. Journal of Laws 2023, item 1587, as amended); - The Contracting Authority requires the above-mentioned subjective means of proof. The mandatory grounds for exclusion of the Contractor are set out in Article 108 para. 1 points 1-6 of the PPL Act. 2. The Contracting Authority provides for the exclusion of the Contractor on the basis of Article 109 para. 1 point 4 of the PPL Act: (1) in respect of which winding-up has been opened, insolvency has been declared, the assets of which are being administered by the liquidator or by a court, an arrangement has been entered into with creditors whose business activities are suspended or is in any other situation of that kind arising from a similar procedure provided for in the law of the place where that procedure is opened. 3.
