Description

1. The subject-matter of the contract is the ‘Supply of two brand-new city buses with a completely low floor, MIDI class manufactured in 2025’, meeting the technical requirements set out in Annex 3 to the SWZ – Detailed description of the subject-matter of the contract together with all annexes thereto. 2. The buses offered must be brand new, manufactured no earlier than 2025, not used for tests, presentations, tests or purposes of a similar nature, as well as equipped with an engine that meets the EURO 6 emission requirements. 3. The bus offered must be a vehicle in continuous series production by the manufacturer at the date of submission of tenders, i.e. it has already been sold by the Contractor (make, model and type of drive). 4. Buses should meet all the requirements set out in the Regulation of the Minister of Infrastructure of 31 December 2002 on the technical conditions of vehicles and the scope of their necessary equipment (i.e. of 29 February 2024, Journal of Laws of 2024, item. 502), issued on the basis of Art. 5 of the Road Traffic Act of 20 June 1997, i.e. of 21 June 2024, Journal of Laws 2024, item 1251), hold an approval certificate and SORT – 2 copies of the Technical Report on Road Fuel Consumption (SORT 2 test) of the buses supplied, developed in accordance with the UITP (International Association of Public Transport) guidelines, in completion and equipment consistent with the vehicle supplied, including the assembly and tyre size identical to the buses supplied. The report should be carried out by an independent certified testing body, authorized to perform the test and prepare the report. 5. The Contractor declares that the buses covered by this contract will be fully functional and will have completion, technical features and parameters as well as quality characteristics identical and in accordance with the Technical Specification and its annexes, which provides (Appendix. No 3 to the RVU), vehicle type-approval certificate (Annex No. 1 to the Agreement) and the requirements specified by the Ordering Party in the SWZ. 6. The contracting authority shall require that in the contract in question the proportion of goods coming from Member States of the European Union or from countries to which the provisions of Directive 2014/25/EU apply by virtue of a Council Decision exceeds 50%. The Contractor's tender whose declared share in the performance of the contract of goods originating in Member States of the European Union or countries with which the European Community has concluded agreements on equal treatment of undertakings does not exceed 50% shall be rejected pursuant to Article 138c para. 1 point 4) of the Public Procurement Act. 7. All bodywork fittings to the passenger compartment and the driver's cab of the buses offered shall comply with the non-combustibility condition EEC type-approval of the vehicle with regard to flammability, obtained in accordance with the conditions laid down in Regulation (EC) No 661/2009 of the European Parliament and of the Council of 13 July 2009 concerning type-approval requirements for the general safety of motor vehicles, their trailers and systems, components and separate technical units intended therefor; 8. The Contractor will provide access to a fully authorized manufacturer's service station operating in the 24-hour system with mobile service (service vehicles) 9. The Contractor undertakes to secure the supply of spare parts within 12 years of the purchase of the buses; 10. The Contractor undertakes to ensure that cooperation on information and technical assistance is maintained for a period of 10 years after the purchase of the buses. 11.
