Description

De gemeente Breda heeft Wolters Kluwer twee overeenkomsten met looptijden van 3 jaren en van 7 jaren gesloten ten behoeve van het leveren van specifieke juridische titels, content en bijbehorende zoekfuncties aan de gemeente Breda.
Deze overeenkomst wordt gesloten op grond van artikel 2.32, eerste lid onder b, onder 3 Aanbestedingswet.
Het beschikbaar stellen van de door Breda gevraagde juridische titels, content in combinatie met de zoekfuncties worden slechts door Wolters Kluwer geleverd. Wolters Kluwer is enig rechthebbende en enig licentiehouder van de juridische titels en content wat maakt dat deze (uitsluitende) rechten moeten worden beschermd.
Er is daarom ook geen sprake van een redelijk substituut of alternatief voor de gemeente Breda nu er bovendien ook geen (onderlinge) concurrentie is op deze markt.
Naar oordeel van de gemeente Breda rechtvaardigt het vorengaande een beroep op artikel 2.32, eerste lid onder 3 Aanbestedingswet.
