1 The subject of the contract is the supply of hardware and software for the needs of the Municipal Family Assistance Center in Białystok. 2. The contract was divided into 5 lots (packages): - PACKAGE No. 1: Delivery of network equipment together with implementation and maintenance service to the Municipal Family Assistance Center in Białystok, - PACKAGE No. 2: Technical support service of the information leakage protection system (DLP) for the Municipal Family Assistance Centre in Białystok, - PACKAGE No. 3: Delivery of antivirus software to the Municipal Family Assistance Center in Białystok, - PACKAGE No. 4: Delivery of a Cal per user license for Windows Server 2025 to the Municipal Family Assistance Center in Białystok, - PACKAGE No. 5: Delivery of All-In-One desktop computers with software and UPSs to the Municipal Family Assistance Center in Białystok. A detailed description of the subject-matter of the contract for each lot is set out in Annex 1A (Package No 1); No 1B (Package No 2); No 1C (Package No 3), No 1D (Package No 4), No 1E (Package No 5). GENERAL REQUIREMENTS (for all lots): 1) The offered subject of the contract should meet the requirements specified by the Ordering Party, in accordance with the detailed description of the subject of the contract, constituting Annex No. 1A (Package No. 1) and No. 1E (Package No. 5) to the SWZ and should be brand new and come from the latest product lines, unused, complete, marketed in the territory of the Republic of Poland, technically efficient. The Contractor shall deliver the offered equipment in original, intact packaging, together with all the documents necessary for the operation of the subject of the contract, including detailed instructions for use in Polish available throughout the duration of the contract on-line on the manufacturer's or Contractor's website or on a CD/DVD, certificates and declarations of conformity, warranty cards and licenses. 2) The delivered equipment should have wiring, power supplies and all other components, ensuring proper installation and use (e.g. power cords, etc.), 3) The equipment should be delivered with all necessary to operate and provide the required functionalities indefinite licenses to use these functionalities, 4) The Ordering Party reserves the right to reduce the amount of the subject of the contract (network equipment) within the limit of approx. 20% with the right to a proportional price reduction – applies to Package 1. 3. Equivalent solutions: 1) Whenever trademarks, patents, origin, source or a specific process that characterizes the products or services provided by a specific contractor is indicated in the content of the FTZ, including the Detailed description of the subject of the contract, which would lead to the preference or elimination of some contractors or products, this means that the Ordering Party cannot describe the subject of the contract with sufficiently precise terms and this is justified by the specificity of the subject of the contract. In such situations, possible indications of trademarks, patents, origin, source or specific process should be read with the words "or equivalent", 2) In situations where the Contracting Authority describes the subject-matter of the contract by reference to standards, European standards, technical assessments, approvals, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the Public Procurement Act, the Employer allows solutions equivalent to those described above, and the above references should be read with the words "or equivalent", 3) Under the concept of equivalent solutions, the Employer understands such equipment that has technical and/or functional parameters at least equal to those specified in the Detailed description of the subject of the contract. The contracting authority shall require, in respect of part of the contract: PACKAGE No 1, PACKAGE No 3 and PACKAGE No 5, so that the supply offered, including all ICT products, ICT services and ICT processes used to fulfil the contract, whether as main components or as components, environmental elements, service provision or ancillary solutions, does not include: - ICT products, ICT services or ICT processes identified in the recommendation referred to in Article 33(1)(b) and (c) 4 of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the essential security interest of the state, - an ICT product, the type of which was specified in the decision on the recognition of the supply as a high-risk supplier, referred to in Art. 15 of the Act of 5 July 2018 on the national cybersecurity system, nor the ICT services or ICT processes specified in this Decision. 5. Subcontracting: a) The Ordering Party informs that it does not reserve key tasks to be performed by its own resources, i.e. without the participation of subcontractors or further subcontractors, b) The Contractor may entrust the implementation of elements (parts) of the subject-matter of the contract to Subcontractors. If the Contractor intends to perform the subject of the contract with the participation of Subcontractors, he is obliged to indicate in his tender the part of the contract (material scopes) which he intends to entrust to Subcontractors, and to provide the names of any Subcontractors, if they are already known.
