The subject of the contract is the service of running a Transhipment Station (hereinafter: SP) in the Municipality of Olsztyn for biodegradable waste with codes 20 02 01 and 20 01 08, by accepting this waste and managing it in a way that ensures the transfer of responsibility for waste management to the next waste holder. 2. Biodegradable waste (20 02 01) â is municipal waste collected in accordance with the guidelines of the Ministry of Climate and Environment, i.e., among others, so-called green and food residues from households and housing estates collected by residents or cleaning services in bulk or in bags â in accordance with local regulations for maintaining cleanliness and order in the parent municipalities of the Company, assuming that waste of kitchen origin will not account for more than 10% of the accepted waste. 3. Biodegradable kitchen waste (20 01 08) is post-consumer kitchen waste - with the exception of bones, meat and other animal residues, with a possible admixture of so-called green waste - from households and housing estates, collected by residents in bulk or in bags, in accordance with local regulations for maintaining cleanliness and order in municipalities, assuming that waste of kitchen origin will account for more than 10% of the waste accepted. 4. In addition, bio-waste will be delivered in a bag or bagless system. The Contractor will arrange separate places for receiving waste in bags and without bags. 5. After signing the contract, the Contracting Authority will provide the Contractor with a list of municipalities from which bio-waste will come and a list of companies collecting this waste. 6. Once the waste has been accepted, the Contractor will transfer it to an installation with a permit for its treatment. 7. Bio-waste will undergo an aerobic or anaerobic treatment in the R3 recycling process, resulting in compost, digestate or other material or substance that is not waste. The resulting compost, digestate or other material will be used as a product, material or substance and placed on the market as a fertiliser or soil conditioner on the basis of a permit from the minister responsible for agriculture (certificate). 8. Under the contract, the Contractor will be required to operate a Transhipment Station for biodegradable waste with codes 20 02 01 and 20 01 08 for a period of 9 months (under the basic contract). The Ordering Party provides for the possibility of extending the operation of the Transhipment Station by an additional 6 months. 9. The amount of waste covered by the contract is: 9.1. as part of the basic contract: 4600 Mg, including: a. 2250 Mg of waste code 20 02 01 in the bag system, b. 2250 Mg of waste code 20 02 01 in the bagless system, c. 50 Mg of waste code 20 01 08 in the bag system, d. 50 Mg of waste code 20 01 08 in the bagless system. 9.2. under the option: 10100 Mg, including: a. 4750 Mg of waste code 20 02 01 in the bag system, b. 4750 Mg of waste code 20 02 01 in the bagless system, c. 300 Mg of waste code 20 01 08 in the bag system, d. 300 Mg of waste code 20 01 08 in the bagless system. 10. Due to the very high variability of the incoming waste stream, part of the waste was included in the option, because the Contracting Authority has no influence on the incoming waste stream (in 2020 the Station adopted 857Mg of waste with code 20 01 08, in 2021, 2022 and 2023 - 0,00Mg) If the waste stream is increased, the option for waste reception and management will be activated. It is estimated that the total weight of bio-waste 20 02 01 will be about 6000-7000Mg in 12 months. 10. The option is set out in Article 441 para. 1 of the Public Procurement Act. The Customer may use the option in whole or in part, once or in several parts. There is an option to increase the amount of waste to be received and managed in the quantities indicated in paragraph 1. 9 point 9.2. above and the extension of the deadline for running the Transhipment Station by an additional 6 months. 11. The customer will use the option if there is a need for further implementation of the above-mentioned services. The contracting authority envisages the possibility of using the option due to the very high variability of the waste stream transferred. 12. Due to the fact that the Ordering Party has no influence and is not responsible for the quantities of waste sent to SP and their quality, they are not guaranteed by the Ordering Party. 13. In view of the subject-matter of the contract, the contract must be performed in accordance, in particular, with the following provisions: 1) Act of 14 December 2012 on waste; 2) the Act of 27 April 2001 on Environmental Protection Law; 3) the Act of 13 September 1996 on maintaining cleanliness and order in municipalities and other laws and regulations applicable to the subject of the contract. 14. Waste that goes to the Transhipment Station will be transferred to the entity holding the decision referred to in Art. 2 point 1 or 2 of the Act of 14 December 2012 on waste indicated by the Contractor before signing the contract. 15. The contracting authority also draws attention to the content of Art. 2 point 6 in conjunction with Article 23 sec. 10 and mouth. 11 of the Waste Act, according to which it is prohibited to collect bio-waste constituting municipal waste outside the place of production, but this prohibition does not apply to the collection of bio-waste constituting municipal waste, in a transhipment station operated by an entity collecting municipal waste from property owners or by an operator of a municipal facility or an operator of a facility for the treatment of bio-waste, and this prohibition does not apply to the collection of bio-waste constituting municipal waste by an operator of a separate collection point for municipal waste.
